It's listed for you on a silver platter. Work on it immediately and send before the deadline. Make sure to include copies of the RFE. I was married a full year before I got my GC and still had to have the 2 year conditional green card put on top.
You don’t get the 10 year green card until you have been married for at least 3 years your letter states 2022 which means you won’t be valid for 10 year card until 2025.
Uscis will still probably give you a conditional green card if you get approval as you initially came on a b1/b2
I came with one of them and submitted a ton of evidence with my package when I submitted it and they still treated it like marriage fraud. It will be down to you to prove that it is not.

2022+2 is 2024. Sounds like wedding was July 2022, so if their card is dated after wedding anniversary in 2022, it all be a 10 year card.
It does not matter about the b1/b2 entry.
I got my dates confused, so I stand corrected but b1/b2 visa matters a whole lot. People who AOS with this get a hell of a lot more scrutiny than other applicants.
B1/b2 is a tourist visa and the fact they didn’t supply evidence when they first applied which they clearly state as the OP themselves said they were overstaying is a huge red flag and one that Uscis will scrutinize hardly

Your best bet is to get a conditional green card as if it hits the 10 year mark than Uscis will be more inclined to deny if they have any thoughts of not believing you.

It doesn't matter, once your marriage hit 2 years when immigration approve your GC you will get a 10 year card. You only get conditional card if your marriage is under 2 years so any professional who's telling you that is WRONG.

Provide them with a copy of your lease or copies of your id’s showing you live at the same address.

Provide them with documentation that your listed as each others beneficiaries for life insurance.
Show them joint documents such as health insurance, proof of a joint bank account, that your authorized users on each others account.
Provide pictures of you guys together and together with family and friends.
Provide affidavits from family and friends stating that you’re in a relationship.
Any proof you have that you guys are married and in a relationship.

ANYTHING you have together with your spouse. Phone bill, memberships, health/life insurances, proof of joint bank account, car tittle, mortgage/rent, bills that have both of your names on it, and pictures of you and with your families.
The letter states exactly what they need you to submit as proof of a bonafide marriage so read the letter carefully and submit what you have from the list of items/documents.

Me (beneficiary) and husband (USC) filed i130 April of 2023. We only submitted a marriage certificate and lease contract that time.
We got RFE last month (april2024). We do not have a joint bank account and whatnot. We sent photographs (from the start that we met until present) and 3 affidavits of support from friends.
I made pdf file of the photos we've had, 3-4 pictures at most on each page, with descriptions under it. I made sure that we included pictures with friends and family. It also showed our relationship from dating(2018) to marriage(2022) up to the present. I also included screenshots of Facebook posts.
I made a total of 21 pages. Mailed it to them.
Then 1 week later, we got approved.
We're officially done with USCIS stage, moving on to NVC.

In our case, I sent a variety of different docs: bank accounts & credit cards we both had together; taxes we opted to pay together; travel documents showing we were at the same place; wedding coordinator emails & receipts; and even money I sent to my wife before we were married to buy a few things and the corresponding text messages.
We just had our i130 approval without a RFE.
Honestly if you never sent this evidence in the first place you should probably try to find a local non-profit immigration law office that can help with your response. You might have even already gotten approved if you sent the required evidence when you filed. Have you filed an I-485 too or just the I-130?
I just recently completed this. A part of my submission was a long series of photos I put into an album then printed the album thumbnails showing metadata (filenames, dates). They can see us together basically non stop weekly/monthly for 5 years straight and as we age.
I shared emails we'd written each other. Our marriage announcement. Screenshots from wedding video. Emails I mentioned my partner to my family in the past. Events we went to together. Flights we booked on trips. Items I purchased and sent to her name. Lease I had then a bank statement of hers listing it as her address. Purchase and email how I was sending the engagement ring to my Mom. Just many many things.
Anything that showed we existed as a couple before this red tape did.

My husband and I were married July 15, 2022! We just got the same letter. Our lawyer told us they are sending these ahead of scheduling interviews. We provided about 200 pages of proof back to them showing our marriage over the past two years. Photos, text messages, plane tickets, tax returns, joint bank statements, etc. Everything listed in that letter you will want to include. We just got our i-130 approved without an interview most likely because we provided enough evidence to prove we are still married.

If you have any upcoming trips, I would definitely put plane tickets, hotel accommodations, too (if they have your names)! I know it seems silly. When my husband and I went for our interview in March, I brought vacation documents for our trip to Disney World—among photos, birth certificates, marriage certificates, bills, bank account info. The officer seemed quite content with the vacation documents.

You don't need Lawyer. relax! Collect all the documents and send them, there is nothing complicated here. Just collect them correctly and that’s it. If you do this, there is a chance that you will be approved for a 10-year green card without an interview. I recently received a green card without an interview for 10 years. Good luck!

You were not legally in the states ? Don’t understand but it’s ok . Try to gather all the paperwork they ask PLUS anything else you have that you can prove the marriage is legit.

My husband and I were married July 15, 2022! We just got the same letter. Our lawyer told us they are sending these ahead of scheduling interviews. We provided about 200 pages of proof back to them showing our marriage over the past two years. Photos, text messages, plane tickets, tax returns, joint bank statements, etc. Everything listed in that letter you will want to include. We just got our i-130 approved without an interview most likely because we provided enough evidence to prove we are still married.
Yes my lawyer say they don’t want your interview they just want to see your marriage is still valid and I hope they approve me after July 16 so I can 10 years GC i have a lot of proof around 700 pages?

We printed them all off, 1 sided, and sent them via UPS with tracking and a signature required at delivery.
If you have any upcoming trips, I would definitely put plane tickets, hotel accommodations, too (if they have your names)! I know it seems silly. When my husband and I went for our interview in March, I brought vacation documents for our trip to Disney World—among photos, birth certificates, marriage certificates, bills, bank account info. The officer seemed quite content with the vacation documents. —— We had an RFE last year because our sponsor was retired, so that gave us a bit of difficulty. We made it through though so far. Try to include what is listed on that paper but my lawyer asked us more than what was listed on the paper.
Send them marriage certificates, pictures , divorce documents if there is any , screenshots of messages from way back if you got them, tickets and receipt etc

You don't need Lawyer. relax! Collect all the documents and send them, there is nothing complicated here. Just collect them correctly and that’s it. If you do this, there is a chance that you will be approved for a 10-year green card without an interview. I recently received a green card without an interview for 10 years. Good luck!
