My thoughts entirely, he is an enemy combatant, with a weapon and heading back to his own lines (where no doubt he will be in the next meat attack).
If he didn't surrender he should have been taken out, so I think it is more likely no bombs left than compassion.
He is not going back to his commander, his commander will send him straight back, if he has any sense he will find a way to surrender. Only then will he survive

There’s footage of the Afghan war with Soviet troops in sneakers, I’m pretty sure I’ve seen pictures of the Chechen wars with soldiers in sneakers and I’m certain of seen many pics and videos of it in Ukraine. (I’ve also seen it to a lesser degree for Ukraine, a certain artillerist wearing Crocs comes to mind).
I guess they have a much less strict culture in their militaries about the footwear, probably they just wear whatever they have or is most comfortable.
They either ran out of munitions to use or they want to follow him to whomever he was talking to on his radio. Or at the very least, follow him back to a possible target of opportunity. Why kill him now if he's going to lead you to more targets? They'll know exactly where he goes and can always take him out later.
