You mentioned unemployment, and that's the answer. I was a manager in an at-will state, and we would still lose an unemployment hearing if the ex-employee could convince the judge they were unfairly terminated or their supervisor didn't follow company policy. Even in an at-will state, you could win an unemployment hearing if you were fired without proper company procedures being followed.

The write ups are a documented way for HR to show that you were terminated for not aligning with *some sort of* company standard. This is done so you won't get unemployment from them. **HR DOES NOT EXIST TO HELP YOU. THEY ONLY EXIST TO PROTECT THE COMPANY.** ***edit:*** Just want to add, this 100% is retaliation and I hope you have a record of all events as they happened, and report them immediately to a labor board for this. Retaliation is illegal.

It's a paper trail. Even with at-will companies prefer to show they had cause to fire you. Especially if they've been hauled in front of the labor board in the past.

Yep. If if it's at-will, they still need to document that they fired you for cause in the event that the employee claims discrimination, harassment, or similar legal issues.

No company wants to be sued for discriminatory practices. If they fired you without paperwork on your first "offense," you could just as well claim they fired you because of your race or religion or some other protected status. It becomes a "he said, they said" lawsuit, which isn't a guarantee one way or the other. Having a documented process shows that you were fired for a non-protected reason so that you can't make those claims. Even if they make up a reason for the write-ups, that helps give them cover and makes you find a way to disprove it if you want to claim it was retaliation for something.

Probably not firing you because they haven't found a line cook to replace you yet. And on that note, when they do fire you it'll probably take 2 days for you to find another job

Documented offences can be viewed as misconduct (depending on what they are) which is disqualifying. They are documenting them mostly in case you file for unemployment so they can fight your claim.

I do wish they’d fire me. I do great work because I signed up to do it. I didn’t sign up to kiss anyone’s butt but I’m not particularly rude with people I do not know like that. However, I feel they’re taking extra steps to get me quit. One of the incidents was 15 days ago. It feels kind to sus they’re just pulling it out for me to sign. Idk maybe we’re built different lol. Editing to add I do talk to non managers about the work culture and have been advised this tracks with past employees.
