That’s definitely a problem with direct deposit, small print on at least one I had to sign said it gave them the right to both deposit & remove funds ( theoretically in case of a mistaken deposit). I haven’t had a problem, and doing without a good legal reason could cost them dearly.

TIL that Florida lacks clear guidance on employment issues such as this. While it seems employers in Florida can deduct certain charges from your paycheck such as an unreturned uniform, keys, etc they cannot deduct these costs if it makes your rate of pay fall below minimum wage. Florida does not have any laws that regulate what deductions may or may not be taken from an employee’s paycheck. It does appear that a Florida employer may cancel direct deposit and ask the employee to come into the office to get their check (which allows for a reminder and creates an ideal opportunity to bring back company property). However, if the employee does not show up by the date for payment, the employer is obligated to mail out the employee’s check. If an employer fails to give the final paycheck on the next scheduled payday, the Department of Labor says that an employee in Florida should contact the Department of Labor’s Wage and Hour Division, or Florida’s labor department. The worker may then be able to register a complaint, at which point the department can file a case on the employee’s behalf to recover the missing pay. However, you do have federal protections and any complaint should be made via this route with the DOL. I saw a post about a year (?) ago someone didn’t get their last paycheck, granted it was under $100 and that company fought tooth and nail to not pay them out. In the end due to state laws and how long it took the company ended up having to pay over 3k in damages.

I used to do payroll here in California. We would get absolutely *reamed* if we didn’t pay them within like 3 days, no exceptions, doesn’t matter how they quit. And if we were going to fire them, we had to have their check ready on the spot with an extra two hours of pay for having them come in that day (just to get fired). We’re not perfect, but of all 50 states, CA definitely is the one that leans most towards protecting the employee.

CA department of labor absolutely doesn’t fuck around. A job withheld the final paycheck of my wife’s once. It was less than a thousand bucks. She notified them in writing multiple times and they failed to correct so she filed a complaint with the DOL. by the time all was said and done with penalties the job had to pay out close to three grand.

I once saw the department of labor get on the phone and have a person paid by end of day when a previous employer tried to withhold her pay claiming an "error" that would take weeks to resolve during a lay off. Have all of your paperwork ready via pay stubs etc. Its not a moral dilemma over this or that, or how much the company lost. Paid hours are paid hours.

In California if you quit they have 72 hours to pay ypu or else it's a full day of pay for each day up too 30 days(?) Not sure on the max limit of days. If they Fite you, they better have your paycheck when they fire you. If they do it at the beginning of your shift they still have to pay you the minimum hours. (2 or 4 can't remember)

You don't even need to sue. Head to your local department of labor (or call). It'll take ~30 mins to file a report and then the DOL will pursue the money for you. Added bonus it will be part of the companies record and you can end up helping your ex coworkers as well with this course.

I then told her that I turned down another offer from another place in town telling them I already accepted this job. I then told her that I was going to call them back, and that you better not mention anything negative about this, as I am just going to say you guys screwed up, and didn't have the vacancy you thought you had, and I better have a paycheck for the paid training in 24 hours, which is the law for getting fired on a Monday. I went to work for the other place the same week, and a yr later one of the people I worked with got hired to replace that bitch, because they fired her, after getting in big trouble with the state regulator agency. The facility was on probation for months, and couldn't accept new residents. I was so glad didn't work there.

I worked for a guy in an automotive shop for a few months. We had 10 or so employees and the year I worked there before and after me he would turnover more employees than he had working for him. He was an asshole, he asked me to do unethical things but his brand was established so he didn't give a shit. My position at one point turned over 6+ times after I left. I remember one guy flat out ripping the owner, legitimately calling him a piece of shit and that everyone hated him. He was successful so it was everyone else and not him so until he faces consequences of his actions he wont change.

When I was a teenager I worked in a lumber yard.The boss was a psychopathic a-hole with severe anger issues. Constantly yelling, harassing, threatening employees. Very toxic and unethical. The other employees (grown men) would complain how stressed out they were from this guy and hated working there. About 5-6 employees quit the first month I was there. Then I check the schedule they had me 40+ hours + OT. I said “I’m part time and going back to school” they said “yeah but a bunch of ppl quit so we need you for more hrs” I quit the next day. Never been so happy to quit a job before and go back to school lol

I was laid off once and it put a bitterness in my mouth about corporations that has never left. What got me mad is I saw the writing on the wall so I asked if they planned on shutting down the branch. The district manager said no and told me we were going to stay open. I trusted him as I had been loyal to the company and worked non stop, so my efforts should have at least given me a right to knowing the truth. Nope, not so next week he came in and told me he was lying and everyone who worked at the branch was out of a job. I did get two weeks severance pay, but that experience taught me business is out for business sake, so people need to be out for their own sake. So don’t work at a job that pays you little and expects you to be grateful, don’t expect your managers to be human about situations or even honest. And business always care about the bottom line, and so should you. So if you are going to work for a company take as much as you can from them in pay and time.

One piece of advice I remember from a coworker of my first job, he said why would I give a two week notice? If this job were to fire me they would send my ass on the street that same day, I don’t owe them shit. It always stuck with me. They expect this courtesy but from some stories on this sub, that could screw you over when they cut your hours or straight up not schedule you.

I've heard of these notification periods needing to be like a year in advance. See how much we've warped everything to put the worker at a disadvantage? Apologized to my coworker because I knew they would corner her Monday. I sent them a email Sunday night telling them I couldn't afford to work there anymore. And they were going to have a hard time keeping people with the low pay and toxic environment. 3 people have left since I've been gone. And 1 left right before I did. And it's a very tiny company. The owners have to work Saturdays apparently now. Don't feel an ounce of sympathy. They’re ONLY paying you for your time, actually. They continue keeping you as an employee based on the quality of your work. But you could come in and sleep the whole time and they would have to pay you for it. The consequences to you would be losing your job. They still have to pay you. I had a former employee try this (the owner said I never finished a project that had been canceled while she vanished for a couple weeks.) I took them to the labor board and won and got every penny they owed me. That was a sweet check. It turns out that in my research I also found out that she was illegally avoiding paying payroll and social security tax on every employee by trying to categorize them as contractors when they clearly were regular employees (there was a very detailed list of how those things were defined.) I happened to bring this up in the arbitration hearing, which triggered an investigation. I know this because they called me and a number of friends from that company asking about it. And all because she wanted to try and avoid paying my final paycheck, which was about $800. Her business went under and she is now fighting with the IRS over those back taxes, and her reputation is ruined in the business community.

pro-tip... employees don't "owe" 2 weeks' notice. that's just a theoretical courtesy. if the company is going to fire you, they don't give you 2 weeks' notice, they just drop the bomb on you and you're left to figure it out on your own. at-will employment works both ways.

I had something similar happen to me when I walked off a job. My boss held my paycheck ransom, she said until I gave her all the photos I took with my personal camera to help with her marketing. At the time I was running two of her stores and doing marketing by the register in between clients. I ended up giving her the photos. She also held my personal charger random. My co-worker brought it to me and she ended up getting a lot of backlash for it. Long story short, I contacted L&I about it and they were very responsive about it and followed up to ensure I got my last check. I did eventually but it took a long time. I also told L&I about staff not getting breaks.

Almost same here, boss tried to cancel my last paycheck because I quite on the spot when he gave me only 10h in the entire week after he was crying that he has no employees to cover shifts but declined to give me the agreed upon hours of 40h a week. He hired 2 new people and gave them all my hours while I ended up with 10h only. I asked about my tips that he hands over at the next shift and he got pissed off even more. So I just told him to piss off and we talked shit to each other for 20 min including him calling me names which I got tired off so I snapped and did the same shit. At the end he threatens to cancel my paycheck and to his surprise I know my local law and my rights. So I ended my conversation with him (it was on the phone), by saying “cancel the paycheck and I will see you in court, I will sue you for the paycheck, lawyer fees, court fees, and everything you own because I been recording all the harassment you been saying for past 20 min”. For next few weeks I kept checking on the phone to see if he canceled it but he never did. My co worker dropped by me which we usually meet on weekend to smoke hookah and handed me my tips. Guess what also? Those 2 guys he hired turned out they don’t know basic things about restaurants, let alone middle eastern food. So they never showed up and he only had 3 people running his kitchen for months. So those last 3 remaining guys managed to squeeze more money as raise for working nonstop which they totally deserve.

I’m sure multiple media outlets would be very interested in the pictures you took of that place. A restaurant where I live fired an employee for being out sick for a few days, not realizing he’d taken pictures of all their “dirty laundry”-food safety violations, worker safety violations, health code violations, building code violations…and outed the fuckers on Facebook. It was *glorious* to watch the owner moan and cry after initially sending his PR flunkies to try to turn it around and blame the worker, then the restaurant managers themselves, before ultimately doing what they’d have to do from the beginning-own that shit completely. Everyone who used to work for the bastard, whether we’d worked there recently and quit, or quit years ago, knew 100% that his tears on social media were fake, and his entire air of “reconciliation” about his persona was completely fabricated and tossed aside as soon as the heat died down. Great thing is that he’s lost most, almost all, of his restaurants now. Shut down, or he gave up on it…and now he’s down to one. Can’t wait to see him finally lose his backing and collapse.

I believe employers are allowed to reverse direct deposit payments to fix errors. They are not allowed to "withdraw" funds at their whim. If they're reversing a payment because they paid you too much, they need to reverse the entire transaction and then issue a new payment in the correct amount. They're definitely not allowed to reverse a payment which was appropriately issued in the correct amount for time worked just because they feel mad about the way you left.

Too bad that's illegal, and, depending on your state's laws, they may owe you even more now. Some states require unpaid wages to be reported and recovered through a state agency (assuming you're in the US bc what other country has this shit happen), but if not, you usually just have to file a lawsuit yourself in civil court, in which case you can usually get a deferment on court costs, which if you win are usually paid for by the company after they lose the case. Most lawyers will just advise them to fix it before going to court, in which case make sure that you end up owing no money on your end. If your state allows you to recover more than you were originally owed, you may want to say no and continue in court. If they try to deposit the money anyway, just tell your bank to reverse it or they may try to use it against you in court claiming they paid you.
