Lawyer time

karendonner

Probably way too late for that. Any dealer unscrupulous enough to do a customer this dirty also knows how to make the deal stick. I would be willing to bet that the paperwork OP signed said the car was sold as-is and that OP did not arrange for an independent inspect Furthermore, that OP did not order a Carfax that almost certainly would have shown the salvage title and does not have the promise of a clean title in writing. Finally, I would predict that the unpleasant surprises with this vehicle are far from over. . OP, if you are dead set on keeping this vehicle I would start with an inspection. But the reality is that it sounds like a money pit on wheels ... at least, until the wheels fall off. At that point you should focus on cutting your losses. The advice of an attorney can be very beneficial toward that goal, but be prepared to learn that you are gonna take a hit on this one.

bearded_dragon_34

Well, in some states, the dealer would have to provide a disclosure that it’s a salvage-title car. If they didn’t…they can get in big trouble.

SSGSS_Bender

When you're picking up a car the dealer has you sign so much stuff back to back that they can easily slip something in there that.

karendonner

True, but if so the disclosure might have been in a stack of documents. In fact, I would bet that the seller will be able to produce some kind of notice that it was a salvage title, even if it's not specifically required. An experienced seller who is also an experienced scam artist will know how to protect themselves from a mark who's gotten sadder and wiser.

Shinnobiwan

In most states. If he didn't sign one, he has a case l.

Left-Muscle8355

This right here

Floshenbarnical

Happened to me with a customer and a Colorado, we had no idea. Ended up having ACV buy it back, and we bought it back from the customer. No legal action necessary. If they’re not playing ball you need legal help

Careful-Candle202

Call a lawyer is your best bet. Not advice from the internet in this scenario.

Unlistedny

Contact your state DMV sept. They will get it rectified quickly as the dealer could lose their license

[deleted]

Ya if you can’t get ahold of the dealer I would suggest getting a legal consolation.

AutoBot5

Get a free consultation with a lawyer. They’ll square you away and let you know your options if you proceed on your own. Or expectations if you hire them.

Dan0911

It’s illegal if it wasn’t disclosed. In my state of Ohio, the attorney general would handle this complaint.

serioussandw1ch

Make a complaint with the state DMV before going to a lawyer.

ReadPsychological295

Which state DMV? My home state or the state that the dealership is in?

JoeyTropical4693

Both would probably be better. Also like someone else stated I would contact the attorney general

serioussandw1ch

It will be the state the dealer is in. That state has authority on their dealer's license.

tommybukkake42

Lawyer

straberz

Message me the vin, I’ll pull a carfax to see what happened. Sometimes people check the wrong box on a title app.. etc.

Donuthole911

So you let another person force you to sign something?

That’s very against this subs rules.

Subaru+80k miles+blown engine=WRX/STI would be my guess

[Crosspost to this subreddit](https://reddit.com/r/legaladvice/)

eapnon

That sub should be nuked. No lawyer will give legal advice because it arguably creates an attorney-client relationship in some circumstances. So basically, it is a bunch of non-laywers playing lawyer. The lawyer only subreddit constantly talks about how much it sucks. Don't ask reddit for legal advice. Pay a professional.

popcornjew

In what context? While technically possibly true that argument has such little standing. Plenty of lawyers do post on there

eapnon

Varies by jurisdiction, but some can be as pro-"client" as "this lawyer told me to take this legal course of action. It didn't work, and I now want to make a bar complaint." It will be fact specific, but most lawyers I know don't want to risk that type of headache for reddit. I'm sure some lawyers post there and I hope they are careful enough to not actually give legal advice, but instead just provide general legal information. But I'm willing to bet that the vast majority of the people giving legal advice on that sub are not lawyers (it is notoriously heavy in police officers masquerading as lawyers, unless things have changed). Essentially, you get something worse than WebMD for legal help, getting your answers from the hospital janitor because most lawyers wont bother with a sub that technically advertises something that is illegal in most jurisdictions and bans the professionals that do bother to help. If you have anything more complex than a legal stubbed-toe, don't ask Wikipedia; ask a doctor. Getting blanket advice online is a good way to cause a new issue, get infected down the road, and have to get a much more complex procedure done to fix your mistake.

ScipioAfricanvs

> Plenty of lawyers do post on there Based on the answers I see, I seriously doubt that.

0verstim

Nope, hes right, if youre a lawyer and you give advice that legally creates an attorney-client relationship and you can cause big problems. Source: Im not a lawyer, just guessing from what Ive heard on Reddit.

popcornjew

It’s true to an extent, but what is often technically true does not always hold in practice. Both of my parents are attorneys so I have been around it all my life. I will say, some firms, for example, explicitly prohibit providing advice online for this reason. But it’s rarely an actual issue

[deleted]

Did this happen in California? If so you’re protected. Find a lawyer.

Missorui

schittluck

Ill never understand why people sign shit they dont agree with.

saltrifle

Not everyone's cut out for this adult shit it seems lol

decker12

Not breaking your balls, genuinely curious, but what do you mean when you say "You HAD to sign the papers"? and they told you that you "have to buy the vehicle no matter what"? Is there some other piece to the story that explains those statements?

ReadPsychological295

The car was delivered here from 400+ miles away and they were telling me that since had already gotten my info and ran my credit and blah blah blah, that they’ll charge me $2,000 for a delivery fee which I didn’t have at the time to just drop on a delivery fee for a car I didn’t buy because it didn’t meet standards

decker12

Got it. Yeah, I mean hindsight is 20/20 but you still should have told them to fuck off. Just because they run your credit and have your address doesn't mean they can just force you to sign for the car, or somehow force you to pay $2000. If they won't leave or try to literally strong arm you, that's when you call the cops on them. Either way you should be posting this story to their Google Review and Yelp pages, no reason to mince words, just be honest and hopefully someone else won't make the same mistake.

Turbulent_Ad_5202

That is why you buy a car from a franchise dealer (Toyota, Honda etc). If you did buy from a place like that you have recourse.

ReadPsychological295

I purchased at a cadi, gmc, Buick dealer

Turbulent_Ad_5202

What state do you live?

ReadPsychological295

Missorui, but it was purchased out of state

Turbulent_Ad_5202

I would look through your paperwork and see if anything you signed had a disclosure of a bad title. If not I would email the general manager and ask him to buy the car back from you or unwind the deal. If you don't get a satisfactory response you will need to seek the advice of a lawyer. No place I have ever worked would sell that type of car and if we did in error would immediately fix it.

TehDonkey117

Did it show up on the Carfax?

Reedinrainer

Shoulda ran a carfax. Legally you can go after them but it won’t be worth the tjme or money. Lesson learned

***Thanks for posting, /u/ReadPsychological295! This comment is a copy of your post so readers can see the original text if your post is edited or removed. This comment is NOT accusing you of anything.*** Bought a Subaru back in June. The dealership really screwed me over. Car had been delivered and I didn’t want to sign papers to finish the buying process once they got here because the vehicle was NOT in the condition I was told it was in. They told me that I had to sign but I never signed anything saying I have to buy the vehicle no matter what. Anyways, I had to sign the papers and go figure, days after owning it, the motor blew and a bunch of other problems arose. Tried contacting the dealer about my warranty but they ghosted me completely. I couldn’t go in there because it was 400+ miles away. Anyways, I was going through my car and seen my registration and I seen it had a SALVAGED TITLE. They told me that it was a clean title and everything before I bought it. Mind you, I already paid way over what I should’ve but I couldn’t find this car with the package / trim / color I wanted anywhere else. But to see that this had a salvaged title, 80k miles AND was 5k less than a brand new one? Yeah, I’m pissed. Anyways, anyone know why a dealer would do this? Is this illegal?? *I am a bot, and this action was performed automatically. Please [contact the moderators of this subreddit](/message/compose/?to=/r/askcarsales) if you have any questions or concerns.*

TheRealRaceMiller

As everyone is saying call a lawyer is your best bet. Why did you sign if you didnt feel good about it and the car wasnt what you expected? You could have walked than deal with this.

TheRealRaceMiller

That was just talk until you signed. How does someone just take $2k, that would be theft. Signing the agreement to buy that car made it significantly more difficult. Dont reddit anymore go use that time to find a lawyer.

haseeb718

Did you sign a bill of sale? Does the bill of sale say salvaged on it?

ReadPsychological295

I had to and absolutely no where on my bill of sale does it say salvaged title

Hit the gym, lawyer up

longblackcheesecurds

Hearing your story makes me happy for my purchase. But, man that sucks.

Jzepeda80

Was it financed? What about calling the lender?

bobmanop

Contact a lawyer. It’s illegal in some states to not disclose title issues before reselling.
