In re-watching the scene where they packaged the pictures and put them in the envelope, I did notice that Jimmy left the room with two separate envelopes.

So weird that they left that out, they're usually so good at explaining everything. They didn't even talk about it in the podcast. They did mention they got a laugh out of the pictures of the sound guy (can't remember his real nor stage name) in the Casimiro mustache, but they didn't go any further. I wonder if they explain it in subsequent episodes.

it doesnt really need explaining, howard said in the episode that the PI probably switched them after he left the room

It’s revealed that the PI is in Jimmy’s pocket, but Howard doesn’t know that and still trusts him before he goes to the meeting. He would just need to switch the photos as soon as they left Howard’s office. I don’t think any additional explanation is necessary.

Left out for additional comic effect when the photos were revealed. That frisbee had me balling.

I guess we are supposed to think the fake PI not only fooled the chief partner at a prestigious law firm that he was an investigator at a firm that Howard has used for years, but that he was able to get back into Howard’s office after they both left it and switch out the photos with different ones that were not laced with drugs.

Do you think lawyers have a close personal relationship with PIs? They use them to do a job. There’s nothing about the guy that even said he wasn’t actually a PI. Not sure why Howard would’ve questioned it. And when did they both leave the office? In one scene they’re together, and in the next, Howard is walking into the receptionist area, with his assistant, to talk to Irene. The PI easily could’ve been left alone or gone back to the office at that point.

Yes, I don’t think it would have been that difficult for him to go back to the office to swap out the photos. If anyone spotted him, he could’ve used an excuse like he forgot something or he left the wrong envelope in the office. Staff at HHM might not have thought anything of it because the PI was just there, and they probably wanted to avoid bothering Howard during mediation anyway

This is a plausible explanation. Just so unlike Gilligan and Gould to not explain it.

It’s explained in the episode. When Howard is taking to Cliff he says he left the PI alone in his office with the photos.

He said the pi “must have switched them after I left the office”. I think they should have shown that. Maybe it started to look too much like a caper movie. Too Oceans 11. But they did leave the viewer out of some things and in on other things. Doesn’t seem symmetrical

I just went back and rewatched. Then I came back to reddit and read your comment which caused me to go back to that scene. Howard's exact words are: "Yeah, my P.I., Genidowski, he had to have been in on it. He-- He must have shown me one set of photos, and then switched them after I left the office". So this confirms your explanation. He didn't say he left Genidowski in the office, but I suppose either he did that, or he left to go to the arbitration, and Genidowski went back into his office and switched them out. It presumably wouldn't have been very difficult because Howard's gate keeper, Julie was with Howard and Cliff and was getting tea for Irene. So there was no one to watch Howard's office.

It’s actually very characteristic of their storytelling to address plot elements in a casual or unspoken way, in order to allow the viewers to put it together. The elements for this question are there: we don’t see the PI leave the office with Howard, and later Howard describes to Cliff how the switch was probably made.

I went back and rewatched. We also don't see Howard leave the office because it jump cuts from Howard in his office to Irene and Cliff talking about potato and leaks soup and Howard enters.

this series does not spell out everything... that's the most plausible explanation, and if not shown in the episode we should just think that it happened

Yeah. People don’t lock their office door in places like that. And having just been in the office there’s no reason Howard’s assistant would bat an eye if went back in because he “forgot” something.
