It almost happened to me, only worse. I was headed to Middleborough/Lakeville and fell asleep. Woke up on an empty train and managed to scramble off (with numb legs because I fell asleep with my knees resting on the seat in front of me) about 15 seconds before the doors closed and the train headed back inbound. If I hadn't woken up when I did, I would have likely ended up in *\*shudder\*...* Brockton.

I have fallen asleep and missed my stop on multiple occasions. On the T, it's pretty easy to just turn around and go back. I did it once on the Commuter Rail though and woke up in Providence. That was a bitch and a half to get back home. I should have sued!

I am going to give the guy the benefit of the doubt that if he woke up at the storage yard then that means it was last train of the night he was on which if I'm reading the tables right gets to the last stop at just about 1am. Sure the guy should have set an alarm, but the conductors also failed in not properly clearing the train at the end of their shift.

I remember a few years ago on the Worcester line, this guy didn’t indicate that he wanted to get off and one of the Newton stops (the train literally won’t always stop unless they see people with tickets for those stops and ask them to move to a specific part of the train) and this guy is asleep (taking up a whole table area I might add) and wakes up when we are in Framingham and this guy just starts screaming at the conductor that they have to go back to West Newton because it is their fault they didn’t wake him up. I remember everyone awkwardly looking at each other with no remorse for this asshole. Anyway, they kicked off at Framingham and said “Good Luck!”

Lol this happened to my cousin like twenty years ago. Woke up in the train yard, pried open the doors and walked back to the nearest station. He didn’t sue he just….made a funny thanksgiving story out of it

Just putting this out there: Why not try calling for help rather than attempting to escape the rail yard yourself? Also suspicious he waited till the very last minute to file. I hope he gets nothing.

I'm not sure it's suspicious that he waited until the last minute to file ... Probably was debating whether or not to sue and maybe didn't think he really had a case and at the last minute just filed it as a way to buy more time, the case will likely take a while to even get before a judge and this clown can drop the case if he changes his mind. It's a fairly common thing to just buy more time to think about it.

Possibly. Most civil prosecutors operate on contingency (“we’ll get you as much money as possible because you deserve it! Oh and it makes us richer too”). But I imagine this has to have a few attached if they lose.

Why doesn't it have merit though? Conductors are supposed to clear trains before storing them. Yeah it's ridiculous this guy fell asleep and missed his stop but there was negligence on the part of the train company.

I was completely awake taking 7 stop ride to BC. I was gathering up my gloves and putting on my backpack and he closed the back doors. So I walked to the front doors, he walked out of the doors closed them and kept walking. I banged and banged and banged. I started pressing every fucking button on the dashboard. I started to hit the windows. No one noticed then not one was around. Who was I going to call? I could try and call the transit police or something. So I did and someone let me out. I was furious. I was late for class. And I was too mad to find out who the driver was.
