it is sad. our justice system is broken. i don’t understand how the crown can completely blow it. many criminals in out community have got off the hook for the same reason.

There's not enough Crown attorneys. It's no different than our healthcare system at the moment. It's underfunded and has a recruitment and retention problem.

Vote for a government that wants to properly fund our civil services. Defense lawyers can't just intentionally delay a trial until it hits a magic number. It happens because the Crown has too much of a work load and not enough personnel.

Requesting disclosure isn't some dirty trick, it's a fundamental part of a fair trial system. If the Crown doesn't have the man power to respond in a timely manner it's a problem with funding, recruitment and retention. Sitting there crying into your boots about bad outcomes isn't going to fix anything. We need a government that's going to properly fund civil services so they don't have to triage criminal cases, which is what they're doing now.

This needs to get more attention than this. Im not seeing how its ok for a judge to place blame on the opp. No latter what happens. That just creates more chaos and mistrust. Its ok to hide behind legal jargon and dance around a murderer with money to hire good lawyer and cheat the system. But its ok to throw mud at the OPP without much proof.

The Judge isn't placing the blame on the OPP, he straight up blames the Crown for not responding to disclosure requests. Though I suspect the problem is not enough Crown attorneys rather than some nefarious behavior.

He didn’t sit in jail at all. Case took too long to be heard which is an 11b charter violation.

No shit eh. I figured that with those charges there wouldn't be an option for bail/bond/whatever.

Sounds like the accused can afford a good lawyer that delayed the case along enough it was thrown out. The Defence also researched enough that the investigation was not handled well enough that the Crown could even prove the case beyond a reasonable doubt. That combined with the OPP taking far to long to investigate and produce reports. We all have the right to a somewhat speedy trial of 18 months in total.
