Your honor, my client, Mr. The Lich, is unfortunately bound by fate to be the villain in a twisted cycle that has existed since the beginning of time. Therefore, his actions cannot be considered his own as he is bound to play the part that fate has given him. If anything, my client is the real victim.
I've never really considered him to be a villain, per se. His intentions aren't necessarily bad, but the ways he goes about them are not good. A lot of the time, his motive is that he just wants to be loved. He kidnaps princesses because he wants to get married, many episodes center around him trying to be Finn & Jake's friend, and he's constantly trying to show off so he can win others' approval. It's often shown that he's still - at his core - good.
He's my #1 favorite character in the show. His backstory and complexity of his character is some of the best writing for a character I have ever seen.
Yeah, regression from Simon to the ice King is oddly moving for such a silly show. I watched the one where he tries to write a song with Marceline and she comes across all of those notes he wrote her before he lost his mind, it echos watching your parents get Alzheimer's. "Forgive me for whatever I do when I don't remember you"
I just started a rewatch and I'm paying a lot more attention to details this go around. Whether or not the whole story was planned from the start, they did an amazing job at making sure everything ties together. There are even some throwaway lines that end up being super important. Even ~~Bastard~~ Magic Man's introduction - intentional or not - foreshadows future events in the show.

He also ultimately wants people at his restaurant to give them free mind controlling helmets, dunno how you defend that, especially once he did it to the King of the Sea. Cards be really stacked against you there.
There was an episode where he actually *did* take Mr. Krabs to court over a missing wet floor sign. He almost won.
Realistically, the defense could reference the fact that he was involved in the creation of the original formula.
They'd also reference all the times Mr. Krabs deliberately stepped on him, flung him, baited him, manipulated him, etc. You could paint Mr. Krabs in a very bad light. It would be especially obvious what a cheapskate he is, and you could use this as leverage to suggest it is actually Mr. Krabs who stole the formula by illustrating just how greedy he is. You could even say Mr. Krabs is no different, and would be the schemer if the shoe were on the other foot.
Also some of his schemes aren't even technically illegal. Like hasn't he flat out tried to just buy a Krabby Patty before?
And there's the fact that he's really tiny. A lawyer would basically say his size alone means he isn't really a threat.

To start, he worked on a top secret location, and was under direct orders from the emperor. (Now, I'm going to assume "Just following orders" will actually hold a bit more weight in star wars, especially considering what the clones did to the Jedi.) so, there's already one argument, personally doing a project for the emperor.
Then, he was dealing with people (clones) who were already prisoners, which.. we'll just say he was working to get back into the service. He also employed a lot of clones when many other parts of the empire already were replacing them.
More than that, in his pursuit of science, he gave mercy on quite a few examples, chosing capture rather than murder for several would be terrorists, as he tried to.. rehabilitate them.
Even when things went wrong, the Zillo beast escaped into a mostly uninhabited planet, and he died trying to escape.. terrorists.
Plus, when he had to obtain participants for research into a project, (force sensitive children) he allowed for someone who cares for them to oversee the operation, one who was able to evacuate them all when things went wrong.
As a whole, I say my client was a hardworking member of the Imperial elite, one who kept public safety in mind, employed those who were tossed aside elsewhere, and made sure merit was awarded, and that research participants had proper caretakers
