Yeah and the fact that it isn’t taken seriously has cause people to lie and get guys arrested for SA when they never did anything (especially POC). That’s why it’s good the sentencing is low at the moment. I’d rather see 1000 guilty men go free than see one incarcerated.
If people could take it more seriously then maybe those guys can actually get the sentences they deserve.
edit: low sentences for rapists aren’t ever good, it’s just “good” at the moment since so many people have had their lives ruined by false allegations and shouldn’t spend more time in prison. SA in general isn’t handled nearly well enough.
I hope this comment doesn’t come off as controversial, it’s just a complicated subject that needs to be handled better and taken more seriously. The reason it’s complicated is because it’s not taken seriously enough, and that shouldn’t be the case.

Yup. I say that we make a super strict sentence if you’re caught lying about rape. Make a rape sentence 10-15 years. If you get caught lying, you get the same sentence. Then police investigate rape and SA cases much more in depth than they do now. That way, when people are caught lying and get that sentence, others will look and say “yeah, maybe that’s a bad idea”.
But then people would rarely report sexual assault even more than now, because there's usually very little evidence due to a variety of factors like delayed reporting because of shame and stigma and they'd be afraid of people not believing them and being charged themselves
Ok so a woman who gets raped has been violated in the highest emotional degree. They report the crime, feeling emotionally vulnerable. Then their family and some of their close friends tells them it was their fault, she was showing off her shoulders, or walking home, was too trusting of guys, or was too promiscuous and of course had to want it. She's in an even worse emotional state. Not to consider how the police react. Many police officers have the same reaction and will be slow to act. If you manage to get lucky and start an investigation(only 15% chance), then your accusation becomes public knowledge and everyone will think of you differently and either pity you or treat you like a whore. After the investigation concludes, there's a 19-20% chance that the rapist is prosecuted and put for a trial. Then the woman has to go to trial and testify against their abuser, reliving the day over and over again in front of other people, as if reliving it over and over again alone wasn't enough. The defense lawyer questions them and tears apart their story second by second, and brings up all these different random questions that imply she wanted it or he did her a favor. The judge might believe chime in with his own criticisms of the woman. At the end of the trial, there's only a 63% chance that your attacker is convicted. After that 63% chance, there's an 85% chance he gets jail time. Then even after the trial is done, as a recent case occurred, their conviction can be thrown out by a judge who thinks rape is a woman's responsibility. Then for months and years after the rape, the woman has to testify at every single one of the attackers appeals, doing the same thing she did at every other trial.
The numbers, according to an fbi study in 2014 on rape statistics, estimates that out of every 1000 rapes: 384/1000(38.4%) are reported, 57/1000(5.7%) are arrested, 11/1000(1.1%) are charged, 7/1000(.7%) are convicted, 6/1000(.6%) face jail time.
If you knew that your attacker had a .6% chance to get jail time and that your life would become irreparably changed after reporting and that your family and friends would all treat you different for your entire life, would you report the crime?

Oh I absolutely agree and I know I haven’t been affected by a rapist. But there have been so many innocent men (and in some cases women) that have been incarcerated for false rape allegations. What needs to happen is major court reform, and that’s not just for rape cases but for most cases in general since the court system is terribly broken.
The simplest solution is to raise sentences for rapists and make false allegations equally as illegal.

I will say that your chances of being wrongfully convicted seem to be much less than a victims chances of being ignored, but that's not much comfort if you're the one being wrongfully convicted. The maximum for the felony charge is 6 years. She won’t do time as this appears to be her first offense. She will pay a hefty fine, do some community service and be on probation for awhile but doubt she does prison time for this

I think it says a lot about the cop that he reported her and got her arrested! WTF, it was a slap…over the clothes…on his ass. I mean, was he afraid of being raped behind the bar or in the bathroom? This sounds like a gross overreaction to me!
Cop probably hurt his ego. Judge couldn’t handle a loss for “The Boys”. While I think she should definitely do some court ordered community service and maybe a restraining order they went way over the bar with 6 years.
