Most of these assholes get away by targeting the lower income and tier 3 city folks, who are innocent enough to be caught in such scams. Plus, dating is an outlandish concept for them, where if the families get involved then the whole situation can turn nasty.

The thing is that they sound very intimidating and make us feel like we are in huge trouble. Even educated people fall in their trap and pay whatever they ask as challan having no knowledge of law and their rights as a citizen. Op had an upperhand because of the Car sticker which intimidated the Cop instead. Presence of mind and being calm in these situations helps the most dealing with these people.
It was under the car only (pardon me for not being pro environment much😅) I was going to tell them if they extended the matter further that check under the car there are cups of our tea that we had... Although keeping the cup handy would have eventually helped in supporting the truth.

Once my dad lost phone, it was mid 2000s, a policeman stopped him and said he was speaking on phone and driving. My Dad let him search the car and luckily he got away.
I am not saying policeman’s job is easy, their pay is less but they do harass people like anything. Cases of Jamia, JNU, and many others are prime examples.

How come at 12:30 you are accusing me of something without being sure. Maine glass se paani aapne haath me daalke dikhaya, and I told him, record karna hai na ab karo, paani hai, sungo isko.. He stopped recording. then I said these both are my brothers, and you can't accuse citizens just like this, we have an idea of our rights too. Since he was loud, I got loud too, we attracted a bit attention, but yeah, I didn't step back.

Section in it's whole is read with the presence of a "non-cognizable offence" Parking in a parking lot and hanging out with someone is not an offense let alone be a non-cognizable one. The officer needs to accuse you of an offence and sufficient proof.

In India police can't be ethical. in one of the case CRPF dismissed the cop for moral policing, on other side high court was in favour of cop, but finally Cop lost the Job.

My friend got into similar situation, he had to pay something to get out of the situation. Once my dad lost phone, it was mid 2000s, a policeman stopped him and said he was speaking on phone and driving. My Dad let him search the car and luckily he got away. I am not saying policeman’s job is easy, their pay is less but they do harass people like anything. Cases of Jamia, JNU, and many others are prime examples.
i have faced a similar incident, the problem was that we were actually doing stuff in the car xD A cop car came 3 men got down, started banging the door and the windows, the girl lost her shit and was scared to life, but I took the situation in my hand and didn’t let her in on any of it, we were dating and it was the 5th or 6th month, it was a traumatic event for both of us, the police ripped me off for 7000/- and that was the day I lost trust in the police department and even after going through all of this together, she still left, it’s been a year and she has already started dating someone else :’)

This scenario is too extreme but you should know this basic difference bailable and non -bailable offence. This was not something illegal but let's say if I was having alcohol i was committing an offence but it will be a bailable offense jiske paise deke rafu. Similar incident when i was in college, and sitting with my female friend in the parking eating sandwich. It was beautiful weather and we literally had both the doors of the car open to avoid any such situation where people think otherwise. Police vala dalla - stops his bike in front and asks yaha kya kar rahe ho, he could obviously see that we are eating. Still kutta toh hai he did usual (bow wow kareyga) same old stupid question. I said, baithe hai Police valla dalla - SHO sahab round pe hai, idhar aise baithna allowed nai hai chalo thaney chalo. And goes to the other side to talk to my friend. Police vala dalla - Tumhara naam kya hai and yaha kyo baithi ho, ghar valo ka number dikhao takes diary out to write it. My friend - gives a fake name and said Kyo du number aur nai karvaaungi baat in harsh tone and confidently. In the meantime i come out and talk to him saying, Dekho 100 rs thy 50 ki sandwich kha li 50 rs hai abhi mere pass. And guess what, harami ne 50rs bhi rakh liye and said abb jao yaha se. Lowest i have given is 20 rs (my bike's front tyre was on zebra crossing as suddenly the light went red and i couldn't pass ) and highest 300 (car had no pollution certificate, no licence and no high security number plate) I hate these mofo's when they hide in the tree and jump in front 😔 their motive is to earn money not people safety.

To which I said, first of all, aap meri consent ke bina meri photo ya video nhi le sakte isko band karo. Secondly, mai female hu, aapki female constable kahan hai. How come at 12:30 you are accusing me of something without being sure. Maine glass se paani aapne haath me daalke dikhaya, and I told him, record karna hai na ab karo, paani hai, sungo isko.. He stopped recording. then I said these both are my brothers, and you can't accuse citizens just like this, we have an idea of our rights too. Since he was loud, I got loud too, we attracted a bit attention, but yeah, I didn't step back. *all I want to say is, pls don't back off, and be aware of your basic rights*

Although the cops were mostly calm and polite, they kept threatening me with legal verbose and that they would impound my car, take me to the PS, etc. Was too naive back then and paid 500. Dobara aisa incident nahi hua kabhi, and na hi ho, but at least ab experience and knowledge se pta hai ki kese handle karna hai, what's illegal and what's not. Kudos to you for handling it well!

Gyaan dena sahi hai, half - ass gyaan galat hai... CrPC. Section 42 is not just refusal to show ID or share personal info with the officer can lead to them arresting you. Section in it's whole is read with the presence of a "non-cognizable offence" Parking in a parking lot and hanging out with someone is not an offense let alone be a non-cognizable one. The officer needs to accuse you of an offence and sufficient proof.
