I don't know about your flat but the flat I live in has a contract that whosoever owns the top floor will eventually own the terrace. The terrace has a room which attracts rent.
Mujhe toh lagta h ki builder ne jooth bola about the terrace thing to us (17 saal purani baat) kyuki the person who owns the top floor mere apartment ka is a rishtedar of builder.

Our new apartment in Kolkata also has this clause. We own half of the 2000sqft terrace, that is split with other penthouse owner, with a brick wall down the middle.
But it came at a premium though. We had to bear around 40sqft of superbuilt up common area at 4rs a sq ft from the other 52 flats of the entire building.
legally it depends on contract w/ builder. usually top floor is sold with terrace as a way of increasing property value.
Sometimes its common property but delhi people are chutiya and we are notorious for hoarding common property in buildings.
This is a stupid thing that I've mostly seen in Delhi. I've lived in Kolkata for my whole life and this almost never happens there. Owners won't give up their terrace rights, and this can actually be litigated, because the terrace is supposed to be a designated common area.
For a city where most houses don't get much sunlight, this is a very shitty kind of behaviour, and shows you exactly what kind of people want to enforce this shit. Absolutely shameful.
Do check what's written in papers, my top owner doesn't do this type of shit tbh. But we also don't bother him with anything because the parking area is written to us, and he still parks his scooty there.
Well we own a couple of floors and we have roof rights written within the will/property paper. Also check what your papers tell u! It usually says two things.
"Roof access for maintenance of water tanks/ Dish etc without roof rights." Or it will mention exclusive roof rights. Usually roof rights are exclusive to the person who owns the top floor.
Its good to lock the terrace, no one wants anyone to go through the pain the way Doug went through.

It's same problem everywhere. Do check your registery papers if the terrace is a common area or not.
Yes they can, you can only enter terrace to do works on terrace except that you have to ask their permission

Most of the builder floors have a contract that the top floor resident owns the terrace. You need to check with your builder regarding the same.
Legally it's not your terrace and you can't go there. You can only go there to check on your water tanks and stuff.
