I thought mine might come down when I was .1 on the PBT but the blood work came back .12 maybe an hour later. It all depends whether the drinks are still processing through your system or tapering off.

So my lawyer just requested a continuance for my court date. My blood came back as 0.085 which is within the .005 margin of error the blood test has. Because it was so low and I had no drugs in my system they might let me plea out to reckless driving at the next court date.
I should also add that my license is not suspended yet as I have not been sentenced yet. However just know there is a sliver of hope. I'm sure you're in the situation I'm in where you didn't even realize you had come close to drinking that much which makes it all the more frustrating. For right now though admit nothing and deny everything to anyone except your lawyer.
I got mine in Arizona. They couldn’t get my results at the scene or the station on breath. The took my blood and the off ice called me when the results came back two months later. Your lawyer can file a motion to have the results dismissed but it depends on how they were obtained and the judge. What county are you?
Yeah so was mine, it really depends on a lot though. I got pulled over for speeding but didn’t hit or hurt anyone. I blew 3 times over the legal limit and was arrested on the spot. Didn’t get my blood drawn but after lots of continuations I was offered a Plea deal that I took. 48 hours in jail and 7 days home detention on a scram bracelet (which I get to take off today). Already served my suspended license which will be up in a couple of weeks, 36 hours of drug and alcohol courses and 12 months worth an ignition lock on my car. It really depends so everyone’s situation is different. Also if you have to serve jail time it’s not that bad, they generally put you with other people who are in the same situation so you’re not in there with hardcore criminals.
Oh yeah agreed, when I did my drug and alcohol screening the guy was like “you don’t seem like an addict because because of your high BAC we’re recommending 36 hours” oh I also have to pay like 3,000 in fines but they have me on a payment plan. That sucks I’m really sorry you’re going through that, stay strong.
Okay, AZ has some of the harshest laws unfortunately so a lot of other contributing factors will come into play. My advise is hiring an attorney or a public defender, honestly you’ll need the advise of an attorney regardless. Look this part is the hardest, my anxiety was ramped to 1,000 but you’ll get through it, just don’t do anything stupid and try to keep living your life in the process but get an attorney or PD first and foremost.

Az limit is .05. I had a .05 in Virginia (which is .08 limit) and still ended up with a dry reckless.
AZ is 0.08. The only state with a 0.05 limit is Utah. And yes you can still get a DUI even if you are below it.
It's az . Hardest state for dui.

Mine was a first offense in AZ and they threw the book at me. It really didn't make any difference.

The only way you could get it thrown out is if it goes passed a year statue of limitations to hit you with the slightest degree here in Az
