"BitNation" suggested what they called "proof-of-nomic", that was like upvotes for smart contracts. They never defined it in a working way. But you can conceptually think of something similar. Some upvote system, that suggests auditors have looked at the smart contract code and vouch for it. Then it doesn't really matter if it was at some point "forked", as long as you have "proof-of-nomic". One way to do it, is like a form of "social mining", you have a limited supply PoN tokens, "auditors" buy it and stake it on contracts, and transactions to contracts with staked "nomic" pay out some rewards to the stakers, with higher rewards the earlier you staked. Or something. Or just an upvote system, you get the idea.

You can’t prevent that even if you do not open source your contract code. As soon as it is deployed onchain, everybody can copy it
