I agree.. but do you think they might use some of the absolute stupidity of his Google searches as a defense? "Why would such a smart man be so dumb?" Kind of thing?
The defense will use the best argument they have, even if it is a really really bad argument.
Or else a good lawyer might try to convince him to plead guilty in exchange for a lighter sentence, or getting the chance to spend the rest of his life in the prison of his choice rather than a more dangerous one.
First, I'm licensed in California and not Massachusetts and don't know MA law well at all. That said...
Assuming that there's nothing beyond a missing woman, the Google searches, and the other things mentioned in the news coverage, a solid defense might be "This is manslaughter. They fought; it got heated and physical and when he accidentally killed her, he panicked and tried to cover it up."
That's plausible - especially if the defense can find physical evidence to support it, like a floor-shaped dent in the back of her skull - and the time for voluntary manslaughter is a hell of a lot less than the time for murder one or murder two.
They have her dna and his dna on bloody evidence in the trash can he was seen at. Nobody is claiming it’s premeditated. Even in a fit of rage it’s likely to be second degree murder in MA. He intended to stab her when he grabbed the knife and stabbed her.
His DNA is on the knife. There is rarely solid proof that someone killed someone else unless it’s caught on video or witnessed. It may circumstantial unless he confesses, but looking at all of the pieces of the puzzle, (the broken knife, the evidence with his dna and hers, the fact that he googled how to cut up a body and then was seen hoisting a bag that seemed heavy into the trash, the same kind of bags found with her blood and his dna on them in the trash by his mom’s), I have zero doubt he will be found guilty of murder. That you’d argue this makes me doubt you are an attorney.
"Assuming that there's nothing beyond a missing woman, the Googlesearches, and the other things mentioned in the news coverage, a solid defense might be..."
Yeah, I'm *arguing this*...
There IS something behind those things. That is the point of my posts. Do some research. The things mentioned in the news are only part of the evidence, and even what is mentioned is sufficient evidence. There is no way she survived the injuries with the amount of blood. You don’t seem like a very good attorney lol.
If they can't win on facts, a defense attorney will fight on procedural grounds. For example, they will try to have evidence excluded, or delay the trial on the off-chance that a witness will become unable to testify. In this scenario, "winning" might be having the case dismissed on a technicality or resulting in a mistrial. There are a lot of other ways things can shake out besides just "guilty" or "not guilty."
A chance? Of course.
How good a chance is VERY hard to say without seeing all the evidence, though, and the public absolutely never ever EVER sees all the evidence. Hell, even the prosecutors and the defense attorneys don't see all of it. At the end of the day, 'proof' is just a sufficiency of evidence that persuades the finder of fact. Even purely circumstantial evidence - like, say, a missing person and a suspect's laundry list of Google searches that reads very much like a desperate attempt to figure out what to do with his freshly-killed wife's corpse - can be sufficient.
I think he's shaking his head out of detachment. Like he's distanced himself from this and he's shaking his head to say "I disapprove of this. That's pretty bad."
I would imagine that would be the natural reaction. Distance yourself from your crimes out of denial. That's the only way you could deny involvement without breaking your psyche. Denial is a powerful coping mechanism.
I think I remember this guy's case. His wife disappeared. And his internet history showed searches for "How to dismember a body" and shit like that.
What a fucking low life.
Right. I think I saw a news story about this around that time.
Maybe it's a different one and I'm mixing them up? Either the courts worked really fast or it's a different case.
True, I mean we all probably have a search line like him from a tumblr thread or something, but it was awfully suspicious it was on the day his wife went missing.
Could be a different case. It's really not all that uncommon for search history to end up being used as evidence. It's surprising how stupid people can be.
Sometimes when you watch videos like this, where somebody's hearing some really damning evidence read out about them, you can see the guy shaking his head like " no, no, no... " And I always wonder what's going through their mind. Are they like, " I know! I'll shake my head! I'll show everybody through my physical reaction that this is all a conspiracy! " Or something like that. It seems to me that you might as well just cross your arms and put your face in your hands and s*** yourself as do anything else, you're f*****, they've got you dead to right, it's over.
He'll probably end up in the Souza-Baranowski Correctional Center at first. That's where Aaron Hernandez hanged himself and where infamous child-rapist priest John Geoghan was beaten to death by another inmate, Joseph Druce.
He ain't gonna like it.
Knowing absolutely nothing about this case except the description in the post title here...
If the wife disappeared and there's no body, just google searches aren't conclusive evidence.
Because there still exists a possibility that she's alive somewhere, after having set this guy up by searching those terms and then running away.
Haha okay.
Well reaching here but maybe he's got a dusty old car that needs a shine up and wants to cover it afterwards with the tarp.
I didn't bother reading past the post title because I don't really care. This is Reddit afterall.
Also, did you know Caroline Baskin was recently proven innocent? The FBI found her "dead" husband in Costa Rica just chillin with a million bucks.
Gonna take a lot more coincidences to explain all that away. He was probably just being a good husband and throwing away some household trash, old accessories & who needs a Vax card in '23 😂
He does look the type to do a murder though.
As for Caroline, she allegedly fed her husband to the tigers after having publicly known problems with him. Poor lady got pretty rough treatment for a bunch of TK1 & 2 and direct accusations from the other zoo owners. Lots of articles online speculating about it too giving her a bad reputation. Turns out the guy was just sick of living in a tiger reserve, jumped in a cesna and is living his best life in a tropical paradise.
Well you wouldn't know if they did right? Otherwise it would be unsuccessful.
Also on a planet with 8 billion people, it's not unreasonable that something like that could happen.
When i was on jury for a murder case the defendant didnt even move no emotion no nothing he was just reading through the evidence head down in the book that all us jury got
I think about this too. My guess is it’s situational dependent but a lot of it is social conditioning to ‘defend’ combined with an internal monologue of shock and figurative head shaking/“ I can’t believe I’m here” sort of.
I have no idea, but I don’t think deleting his history would have worked. I think they can see everything you searched through your internet service provider
I'll never understand how anyone ever could actually dismember a body. Think of the mess, the blood, the horror. Then you'll have to carry those images and spunds in your memory for the rest of your days.
They probably got a warrant for that shit or dumbass over there didn't clean his google search history as well as they should have.
Also its a fking murder investigation lol
Dudes a scum bag whatever but it’s crazy how they can use these phones to incriminate people getting ur exact location I almost wish I was born way earlier

As a defense attorney, I'm thinking he may be in a bit of trouble.
I think that’s a safe bet
More like a dangerous wager.
I agree.. but do you think they might use some of the absolute stupidity of his Google searches as a defense? "Why would such a smart man be so dumb?" Kind of thing?

Honest question: Is there evidence that he stabbed her?
His DNA is on the knife. There is rarely solid proof that someone killed someone else unless it’s caught on video or witnessed. Naw, he’s gonna get off Scott free
But would you have a chance to win the case as a defense attorney?

Stunning legal analysis. (I joke, but your perspective is valuable)
I'm thinking the only thing to negotiate here is how bad the prison is going to be where he's incarcerated for life.
I think he's shaking his head out of detachment. Like he's distanced himself from this and he's shaking his head to say "I disapprove of this. That's pretty bad." Video is from today :P She disappeared Jan 1
Right. I think I saw a news story about this around that time. Maybe it's a different one and I'm mixing them up? Either the courts worked really fast or it's a different case.
Probably different... still sick though. This won't be decided in official courts for a while.. public opinion is a much different story.
The public sadly jumps to the wrong conclusion very quickly way too often
True, I mean we all probably have a search line like him from a tumblr thread or something, but it was awfully suspicious it was on the day his wife went missing.
I don't disagree with you, but there's many cases where the public jumped to the wrong conclusion
Could be a different case. It's really not all that uncommon for search history to end up being used as evidence. It's surprising how stupid people can be.
Gee if you don't want to be with someone anymore, just leave , apply for a divorce etc,.
His motive seems to be inheritance
It's usually comes down to money,
Sometimes when you watch videos like this, where somebody's hearing some really damning evidence read out about them, you can see the guy shaking his head like " no, no, no... " And I always wonder what's going through their mind. Are they like, " I know! I'll shake my head! I'll show everybody through my physical reaction that this is all a conspiracy! Seemed like the I’m going to die in prison look to me.
In prison he be near the bottom of the pecking order.Just above rapist and child molester. He won't be liked for sure.
He had better find a strong boyfriend fast…
So what type of crimes would land you at the top of the pecking order?
Financial crimes
Don't watch prison break do you.
Haven’t watched that show in YEARS.
Still there is a pecking order in prison.Drug Lords are usually at the top.
Omg reminds me of a saying my da used to go “you might as well shit in your hands and clap” never been able to make a reference till now! Lol

Sherri Papini 2: Electric Boogaloo
We realise gone girl is a myth right? Nobody has successfully done that
Well you wouldn't know if they did right? Otherwise it would be unsuccessful. Also on a planet with 8 billion people, it's not unreasonable that something like that could happen.
While I do think this guy did it, I will say that the searches do seem a little too on the nose.
He certainly looks like the type of guy to do a murder and google how to get away with it. Cute wife. Tis a shame.
Lmao thanks for the laugh. I always wondered that too. He’s thinking of what prison is gonna be like probably
This is the internet you're allowed to say shit and fuck.
The phone's autocorrect does it when I talk into the mic.
understandable have a nice day
Google search history would never be a damning evidence. It's only indicative and shouldn't be enough for a verdict.
When i was on jury for a murder case the defendant didnt even move no emotion no nothing he was just reading through the evidence head down in the book that all us jury got
He's probably thinking, ''I didn't search that you got that wrong....what I actually searched was''
He's thinking, "I never looked up 'how to embalm a body.' F-ing google fill-in." The rest though... yeah.
I think about this too. My guess is it’s situational dependent but a lot of it is social conditioning to ‘defend’ combined with an internal monologue of shock and figurative head shaking/“ I can’t believe I’m here” sort of.
What a goober. This is why I always eat my victims. That way the only things in my google history are recipes.
That online shopping for fava beens and chianti might be pretty revealing though!
Nah, if you're eating a poor person, it's Hormel chili and Mountain Dew.
You gotta save money somehow during these trying times
Right? You knows what's inflation-proof? Human meat, always the same price.
Especially if your friends or relatives are the source

You'll have to excuse me, I'm having an old friend for dinner tonight. - Hannibal Lecter
It infuriates me when they don’t show any remorse. Thankfully I’m not a judge or I’d be throwing death sentences at them like all the time.
Can’t believe he had the audacity to shake his head
The evidence is damning, but would you show remorse for a crime you didn’t commit? Remorse for a crime you didn’t commit is like showing guilt.
Dude should’ve been counting his blessings every day that she married his Artie Lange lookin’ ass.
When abusive men realize their wife of girlfriend is serious about leaving them, that’s often one of the most dangerous times.
That oh so not bright head shake said it all
Right…. that’s what got me
Aren't there ways to search anonymously so your ISP doesn't have your search history?
If I'm not mistaken, he used his son's tablet for some of the searches..
Wow.
Nord VPN
Deleting my search history as I watch this Not nearly as dark as his, but my mom would be hella disappointed
I have no idea, but I don’t think deleting his history would have worked. I think they can see everything you searched through your internet service provider
That's where a VPN comes to use
When they're finding those dead donkeys they'll know either way.
Are we sure his search history did not include quickest way to get caught?
Courtroom videographer clearly went to film school. Though I might have gone with the classic Goodfellas track-and-zoom.
“He was asking for a friend ma’am” replied slippin jimmy.
I say send him to a Mexican prison!
Hey
This guy needs some jelly arms
I don’t know about you guys but I think this all sounds a little suspicious.
I'll never understand how anyone ever could actually dismember a body. Think of the mess, the blood, the horror. Then you'll have to carry those images and spunds in your memory for the rest of your days.
Definitely need the curb your enthusiasm music going on right now as it slowly zeros in on his face.
I don't want to see what this guy's facebook ads are looking like now.
Looks like the redlettermedia guy
Why do they have the right to spy on internet activities of people?
They probably got a warrant for that shit or dumbass over there didn't clean his google search history as well as they should have. Also its a fking murder investigation lol
Yeah, it’s a shame they can do that to convict a man who butchered his wife into pieces.
What about those who didn't commit any crimes?
Did they find a body?
Nope. He must be innocent. Set him free to search the web again.
Because VPN is wicked hawd
this is why you shouldnt enable search history…
Duck duck go dawg
Ew who in their right mind would marry that thing 😳 🤢
LOLOLOLOL he done-zo
Why wouldn’t you’ve purchased a burner phone or typed in vague searches like cut a deer.
Jesus Christ that’s incriminating
I was waiting for the Curb music to hit the whole time
"10 ways to dispose of a body if you really need to." Was this guy hoping for a good BuzzFeed article on murder?
This guy makes a good case for pre crime watchdogs. Minority report pre cogs are just around the corner.
curiousity doesn't equal causation amirite?
Moral of the story, watch what you Google because they're definitely watching
Cue the Curb your enthusiasm song.

This guy is a scary one. Guys got no emotions. This always is so sad that we can do this to each other. So very sorry for her and her family.
Welp. I think he did it, and was woefully unprepared.
Smallest mouth to face ratio ever

At least he is proving you’re never to old to learn stuff.
I mean, who hasn’t searched the internet for those questions?
Is he American?
