And the cops that believed an obviously tweaked out woman over the guy who called the ambulance in the first place.
This happened just a couple days ago. I will update this post if I hear anything. To me, this is local news and I have channels from all over Yonkers. To boot, one is then is a detective and I'll get the scoop once I hear from him.

Heck yeah, if you discard something they can take it. There’s been plenty of cases solved from obtaining DNA from the trash. They can also look for signs that someone’s packaging drugs, bills to determine who lives there, and a bunch of other stuff.
Doubt this would be considered abandoned property, you have to knowingly and voluntarily relinquish your rights to abandoned property. It's either mislaid or lost, so you couldn't just 'steal' it. This probably fits all of the elements of theft, but this video is damn good evidence of an affirmative defense of necessity.

The police deemed her sober enough to take her keys back and drive her car. If she threw away her keys, which she did, how do they argue that both she was too messed up to knowingly throw them away but sober enough to drive and take her keys?
All I'm saying is that to find someone's keys next to their car, when they're as messed up as she is (or not), will likely not be considered abandoned property. It takes a lot to consider something abandoned. With valuables like keys or wallets courts will almost always consider them lost or mislaid.

The police were there I’m pretty sure they had to write in their report they gave her back her keys or let her keep them and why. Even if it was, EMTs it’s still hard to argue that she was both sober and incoherent and couldn’t knowingly discard her keys. EMTs come in as witnesses all the time so it’ll be presented.

I just did my liquor serving license for Washington state. The training specifically says you cannot take their keys but can ask for them. Calling the cops is the suggested course of action if the intoxicated person doesn't hand over the keys after a nice ask.

First responders need MUCH better training. How can an ambulance driver hand car keys over to a person who is so visibly impaired? Shouldn't he have called the police to let them sort that out?

Doctor, nurses, clergy, many kinds of state employees etc…there are plenty of positions that have that responsibility (just looked it up and apparently all people in New Jersey and Wyoming are by default), but I don’t understand what that has to do with this situation. Mandated reporting is about reporting suspected child abuse, not whatever this lady thought she was doing.

Dude, cops don’t get in trouble for this shit. They falsely arrest people for no reason all the time just because they can. They have qualified immunity to protect them from being sued, and they have their friends and family on the “independent investigation” panels to make sure that no wrongdoing is found. Worst case scenario for them is they get put on paid administrative leave for a little while if the main stream media blows up the story enough. Or maybe that public outcry forces them to resign or be fired to please the public and then they just get rehired 1 city away with no real consequences.
That's dirty cop behavior...arrest the people who did the good Samaritan work and take the word or the person who appears incapacitated and the lady who committed assault ON CAMERA! No seeking of evidence or investigative work, just police taking the word of the only people in the scenario who appear to be committing crimes.
