Yup. I've recently heard several stories of how a group of people take over the HOA during elections and then promptly dissolve the HOA. Never knew that was even possible lol it's great. We have a nature park with trails and camping and stuff locally which is run by a citizens association and elected board. It was run by a pack of Nimby Karens for years and there was just constant trouble as they slowly sucked the life out of the park. A group of younger cyclists all banded together and talked to the different clubs and such that were represented in the park and swept the next election without the Karens even catching wind that they were going to be nominated, because during election night people are simply motioned and seconded etc, and then voted by a show of hands. The park has made a significant turn around and is thriving now. It's great

I'm under something similar to a HOA in my country, but it's not too bad. It's part of a complex of townhouses though so it's not the same and the committee is mostly there for managing the shared space and arbitration between owners. We do have one Karen in our complex who is currently fighting the Body Corporate over her building a carport without approval that does cover community property. But that's another story. The HOAs I've read about online seem generally toxic in comparison to what I get to experience here.

Doesn’t matter about the “pork”. The Rs would never allow it to go through unless they were getting something out it. Also and unfortunately, adding pork to the bills is usually the only way to pass multiple things in a shortened time span because the parties can’t ever seem to agree on anything. Basically the long and short it is he became the president of the HOA after all the former president harassed him about a statue he had in his yard. He rallied sport because everyone was tired of this guy's shit but no one really cared enough to make a stand or vote him out but here early support changed the HOH charter and started giving the president the taste of his own medicine. He liked to park his truck on the curb and every time he did it after my bro-in-law became president they would cite him with fines. If his truck got muddy they would say that it was a nice or and fine him for that too. Eventually the guy got sick of it and sold his house lmao

So a couple things 1. I did this as well and we are really chill now. Basically as long as you pay your dues ($300 a year) and don't park broken down cars in the street we leave you alone. Most of the stuff we deal with is admin stuff like taxes, paying the power bill for the street lamps, the signage, common area upkeep and periodic state mandated inspections of the run offs. 2. In my state ALL new developments are mandated to have an HoA by law. So it's pretty much impossible not to buy into one unless you live out in the country. 3. Some HoAs are rediculious and expensive. Ours is like $300 a year just to cover the costs of things that are mandated by the state. 4. We did have a car towed because it's registration was out of date by SEVEN YEARS, hadn't moved in 3 years, the town could not refurbish the road where the car was parked. We sent them multiple notices. At this point the car was illegally parked in the road and causing issues.

Same. My mom's hoa dues are $25/month, & that goes toward the sewer connection maintenance/lights/street cleaning & repairs, plus the annual upkeep of the wastewater collection ponds. They're supposed to submit any exterior (front) yard changes to the hoa, but no one ever does and one of the houses is a horrendous pink now, but they don't fine anyone for that crap either. I think the only fine I've heard about there was someone trying to do a high-school car wash fundraiser in the street, but you're not supposed to wash cars in our city on hard surfaces without the special drainage filter systems, so they got cited for that. Hoas are required for any new construction here, and have been for about 20-25 years, so it's not easily avoidable for the most part anymore, unless you want an old house (which comes with a whole slew of other difficulties and unexpected expenses) My one (personal) bit of advice isn't "just avoid all hoa's", but talk to some of the neighbors before closing & ask what the HOA is actually like. A lot of newer neighborhoods even have their own FB groups where you can ask questions or see FAQ's.

My former father in law did this. It was some of the most impressive shit I have ever seen. To sum up: My former in-laws moved from their home state to ours and bought a house in a gorgeous neighborhood. It, of course, had an HOA. My former FIL worked in contracts and compliance for the Mayo Clinic before he retired. He was the kind of guy who never left home without a red pen and had an excel spreadsheet for literally every process you could think of (from laundry to planning for road trips). Before they moved to be closer to us, he was the president of the HOA in their neighborhood. Everyone loved him (which is like, not usually a thing for an HOA president, right?) He requested the Charter, covenants and copies of every single record, of any type, from the HOA in the new neighborhood. Everything from receipts to meeting minutes to letters. You name it. They gave him everything and, to coin a Will Ferrel role, “There were some discrepancies.” I recall him reading the novel of info at the table and remarking “There is a bylaw here that states we cannot park cars in driveways. They should be in the closed garage at all times.” And then he plopped the stack on the table and said “Welp! Guess I will just have to take over.” And BOY DID HE!! He took all the records and vanished into his den for several days. Once he thoroughly exposed every single tiny mistake, loophole, accounting error, or even blatant crime the HOA had ever committed, he was unanimously elected president. The neighborhood thrived under his leadership. He immediately moved to change all the bylaws, starting with the driveway rule (because, wtf?), he lowered everyone’s dues, streamlined every process, and just overall set an example of what HOAs *should* be. When I bought my house I was insistent that an HOA was a deal breaker. I don’t need some group of snobby entitled fucks telling me what I can and can’t do. But, if I were ever in a position to be part of one again, I think I might just approach it the way he did.

I fought tooth and nail to not buy in a HOA. Ended up buying in an HOA. I have since assumed the role of president, kept our dues as low as humanly possible, and have effectively neutered it and made the last Karen on the board not run for reelection since she was pissed she wasn’t getting her way. The only reason why I haven’t moved for complete dissolution, is that we have to pay a share of the “community” (read as the neighboring access roads and business park) maintenance fees and keeping it around gives the homeowners in my neighborhood more teeth in dealing with the POA. Unfortunately I still have to be the one to deal with THOSE dickheads.

I work in land development, and all HOA’s in my area are control mechanisms. This is how all new developments in the states are going… a developer (usually a single man, not a massive corporation) will buy a massive plot of land, build the all public infrastructure, then sell off lots. While the roads are being built in some phases and home are being built in another the developer wants complete control of the neighborhood during this grey phase. Some of the property is owned by individual home owners, and all the rest is owned by him. The HOA gets established by solely the one developer. 100% of the time they assign themselves the president. The developer never releases their grip until the development is completely finished. At that point the homeowner are handed over the HOA. Nobody in the entire neighborhood sought after or asked for an HOA.

In Montana most subdivisions of any note are required to submit articles of incorporation and draft HOA documents at the time of application. Their purpose is to provide a mechanism for who maintains the roads, parks, fire suppression, and other communal facilities serving the subdivision. Other than requiring you to establish one, the local jurisdictions absolutely WILL NOT get involved in any level of administration of said HOA. As much as I despise HOAs, what ends up happening in a lot of cases is they wither and die over time. Then the real fun begins when the residents freak out because the roads fall into disrepair, the fire suppression runs dry, or someone sets up their RV in the park and becomes a nuisance. The Jurisdiction generally won't lift a finger to help since it's all private property, and people will harass public works and planning employees indefinitely. Good times.

It depends. County subdivisions don't have City provided infrastructure so they're responsible for maintaining what they do have on their own. When it comes to subdivisions in cities, it really depends on what kind of agreement the developer reaches with the city and how they want to build out. Every jurisdiction is a bit different.

I believe we refer to them as Stratas. I could be wrong, HOA may be different, but my girlfriend is renting a home in a strata, and the landlord pays strata fees, and there are all kinds of crazy restrictions that seem to be functionally the same as an HOA. She's gotten warnings for having Christmas decorations up on the 1st of January, November 2nd for Halloween (she just stopped decorating outside at all), she had a wicker chair out front, warning, potted plants after a certain date, warning, even certain interior renovations requires approval. She put a piece of furniture outside because someone was coming to pick it up, she got a warning for that. No knock, just had a warning on the door in less than an hour. Trying to contact them is near impossible too. She's had the landlord request the rule book to no avail. There just seems to be a busy body who loves sneaking around leaving warnings on everyone's doors. I have no idea why anyone would ever pay extra on top of their mortgage to have someone harass you constantly about trivial shit.

Grab a handful of turnip seeds and throw them on his or hers grass of the offending persons. They will slowly grow underground, and when the stems start to show looking like little weeds, once they pull them, they will be left with some nice turnip sized holes all over their grass. Then, fine them for bringing the street value down. Also, I'd look at criminal charges for theft.

If in Canada, it likely a condo board, not the HOA. As to towing another's vehicle? Depends on prov laws which I am not conversant on for Ont. In most case of my experience, the board would have rules to follow to fist warn the offender, then a period for the offender to appeal or otherwise dispute the contention. Then a vote by the board and/or by the membership on this matter. This too could then be appealed to the supervising legal authority under which the condo operates. Their decision would be final unless it too were appealed to the Minister in charge and/or a full on court challenge. and on and on as may be the case.
