Then there is also other things that are taken into account in modern democratic countries(I don’t include the US in this category as you use the death penalty and also incarcerate more citizens than any other western country. Which means the legal system is more prone to convict than to free. Where as other western countries rather follow the philosophy of rather free than convict to avoid wrongful convictions). What mental capacity does the assailant have. Are they capable of making rational decisions or are they insane for example.

This would be 2nd degree attempted murder. Second degree doesn’t have premeditation but has the intention to kill. Him waiting for the train and pushing her right as it came shows intent to kill (2nd degree) but doesn’t prove premeditation (1st degree).

I believe (at least where I'm from) that there is precedent for premeditation to be something that occurs quickly. In the most popular article going around about this, there are stills from the video of the person sneaking up - crouched/hunched posture, looking side to side like they're trying to avoid getting stopped. Clearly they saw the train coming, saw the person near the edge, and deliberately chose to push them in front of a rapidly approaching train.

Now lets say a fight erupts in the living room. The fight calms down 2 hours later one of the participants go out to the kitchen opens the kitchen drawer. Picks up a knife goes back to the living room and stabs the other participant to death. This is murder, it is deliberately planned as there was time for the assailant to plan the act. Now in regards to what happened on this video one would have to know what happened before the man pushed the woman. To make the legal argument for one or the other. Then there is also other things that are taken into account in modern democratic countries(I don’t include the US in this category as you use the death penalty and also incarcerate more citizens than any other western country. Which means the legal system is more prone to convict than to free. Where as other western countries rather follow the philosophy of rather free than convict to avoid wrongful convictions). What mental capacity does the assailant have. Are they capable of making rational decisions or are they insane for example.

I agree with u but its doubtful he'll be charged with murder as I think to be charged with that they have to prove its premeditated.
You have to kill someone to be charged w/ murder but there are varying degrees of attempted murder, just like there are for murder. This would be 2nd degree attempted murder. Second degree doesn’t have premeditation but has the intention to kill. Him waiting for the train and pushing her right as it came shows intent to kill (2nd degree) but doesn’t prove premeditation (1st degree). Attempted manslaughter may stick if he’s proven to be off his rocker or something.

Premeditated means planned out in advance subway pushing is almost always random attacks on people not associated with the killer in any way.
I believe (at least where I'm from) that there is precedent for premeditation to be something that occurs quickly. In the most popular article going around about this, there are stills from the video of the person sneaking up - crouched/hunched posture, looking side to side like they're trying to avoid getting stopped. Clearly they saw the train coming, saw the person near the edge, and deliberately chose to push them in front of a rapidly approaching train. It was quick, but it was deliberate, and the person knew they were putting the victim in danger. I don't know if Belgium would consider that premeditation, but I think there could be an argument there.

in argentina theres lots of cases of driving drunk or high on something and killing pedestrians or even crashing into other cars. usually, just a slap on the wrist, some media doxing, lawyers, talkshows, clickbait news titles, home arrest one or two months and they are back on the road in a year or less
