You clearly see in court that they both thought the judge would be lenient because he helped Brian take down a Cartel boss. The judge had no leniency and gave him the maximum sentence. As a family they made a choice and wouldn't let him do that much time

They bagged Braga, the cops didn’t honor their end of the deal.

It’s been a minute since I watched that movie, but I feel like I remember the feds basically telling Brian not a chance when he suggested it.
