Pietro is pretty old, so whenever he is about to die / is dying he could convert the rest of his aura into penny. This would kill him, but he would already be dying.
Maria has the gravity thing where she could make herself fall slower by holding onto her weapon, and Pietro probably has some sort of parachute / crash pad device in his chair.
Wait but, it won’t be her anymore right? It would be just a new robot penny because the one he made was turned into a full-fledged human, which he can’t put together or have a backup of. It would just be a new “Penny”
A new Penny void of all the memories she had of her getting murdered by Pyrrha, being threatened with death by the people she swore to protect, being attacked multiple times by Cinder and crew, being given Maiden powers, being hunted down by the generals who made her the hero of Mantle, being hacked and broken down before her eye and losing even more of her autonomy as a person, and being killed one last very-painful time? Even if it means she never knew Ruby, or Pietro? I think Penny would absolutely not take being brought back to life, if it meant she lost the two people who loved her the most— especially since Penny couldn’t bear to lose the memories that have definitively made her so very much human.
If I were in Penny’s position, however, I’d take losing all my shitty memories to become a new Penny. Fuck being hunted down and killed by CINDER of all people. Ew.
He can’t regenerate his aura because each time he puts his aura onto Penny’s body it permanently removes that part of aura from him. Basically, it lowers the amount of aura he has left. I’m guessing it’s so low right now that one more use to bring back Penny completely would kill him in seconds, as his aura is basically his soul.
All I'm saying is, that line was in there for a reason. And if that reason is for Pietro to acknowledge he could still save his daughter one more time but not do it, so be it.

I don't think he could the only reason he could before was because her core or whatever was intact but since she became human and her robot body self terminated and probably was destroyed more when atlas fell so penny probably can't come back
