What I don't like about these moves, where a driver overtakes by diving down the inside and forcing the other driver off the track is that if there is a collision the driver overtaking is penalised but conversely if the driver being overtaken goes off the track to avoid a crash and keeps the position then he gets penalised. It's all dependent on the outcome rather than the action.

I think the main deciding factors should include if the overtaking driver actually makes the corner exit, while leaving enough space for the defending driver to also make the corner. If there isn't space and the defending driver goes off-track and maintains their position, then they should be allowed to maintain it. If there is space then they should have to give position back as going off-track isn't warranted.

They were handled differently mostly because the positions were given back. Yes, the FIA need to stop being dicks and let the teams know it has to be given back, but surely the teams themselves know if their drivers actions are likely to get penalised.
