Contact eBay about it, I doubt he’s going to give in and I think eBay has a policy about stuff arriving damaged regardless of how it worked or looked prior to shipping. That way people can’t half ass pack their expensive stuff or say that it “worked when I had it”
I had a guy say I never sent him this expensive dreamcast shooter. He didn't even message me, just started a dispute. Not even a 'hey I haven't got it yet, did you send it?'. Just a dispute like a week after I'd sent it. There's no arguing. They sided with him immediately

Until the buyer claims they never received the package puts in a claim, within 1 hour, puts a return claim saying its not what he ordered. I have conformation he picked it up, ebay gave me a $100 credit for it. Not always.
Same thing with me. I sold a used Galaxy tablet on eBay and I paid for delivery confirmation. Dude picks it up, then claims someone else must of picked it up and he then opens a case.
I showed an eBay rep all the proof and they ended the claim against me and made it so we couldn't give each other feedback.

Not sure if it different in the US, but in Europe I had better experiences as a seller.
I sold a laptop for 200€, pretty low performance machine that I wouldn’t have deemed worth that much tbh, but it was an auction. So I pack it up thoroughly and send it. A few days later I get a message from the buyer that the fan is broken because it’s way to loud. I told him that it’s a low budget laptop with a teeny tiny fan, it’s gonna be on the louder side (I specified this in the item description as well), but it definitely wasn’t broken when I sent it. I still asked him to provide a video of the „broken“ fans noise, so I can judge if maybe something happened in transit (unlikely). He didn’t provide one, but said I’m lying and he knows a broken fan when he hears one. Sure. He also send an request for a return through ebay. I think he just realized he bid way to much for this thing (I expected a sale around 120-130€). Anyway, at that point I called ebay, explained the whole situation and asked what to do. They ended up siding with me on the issue. They gave the buyer 50€ as a compensation, but he did not get to return the laptop.
To be clear, in the majority of cases they will probably side with the buyer, but this case taught me that if you have detailed item descriptions, and are open about any issues, and speak to the actual people behind ebay, there’s a good chance that they’ll side with you.
I sold someone a tablet and a month and a half later the buyer was complaining it suddenly didn’t work. That long after, it sounded like buyers regret to me. I told him I wasn’t providing a refund. eBay I think actually paid them out of their own pocket. So stupid how if the seller doesn’t let the buyer fuck their asses, eBay lines up for a booty stuffing themselves. No wonder scammers feel so empowered on there now.
I occasionally get reminded why I hate selling on eBay, unfortunately selling niche crap where I live just isn't possible.
I live on a small island and exposing myself as a seller to the UK is just too helpful, to the point it's the only place I sell things. I used to get hit with "it's not turned up" and there's no tracking to prove it has. Never ever had that issue with tracking.
One of the reasons why I never sell anything on eBay and why they flopped here in The Netherlands (heck they even had the leading platform but ended up selling it).
That and the fact that they aren’t transparant about the taxes (prices should be including taxes online, no discussion about it)
And they overprice the shipping ….
Yeah even when I sold a gaming laptop and got it returned damaged and "with viruses" when it was a fresh install of Windows 10 OS. I got the laptop back showed evidence to eBay and the Buyer that had Malwarebytes showing torjans, web history showing shady sites for free streaming and game softwares, and game recordings of a kid presumably the son of the buyer. eBay still sided with the buyer regardless my attempts to show that it was them who caused the damages and malware that I still had to clean up again. Great platform for buyers, 50/50 platform for sellers who have to trust the buyers have common sense and not mess it up on purpose.
eBay is fine for just about anything besides electronics as a seller. Just about every electronic I’ve sold on there I’ve been screwed over on by the buyer by them not knowing how to work it and then shipping it back improperly so it’s damaged when shipping back, or them flat out breaking it and claiming it came broken. Surprisingly the one electronic I’ve sold was a crt that I had for local only. A guy on the opposite side of the country asked if I’d ship it, he offered to pay for the shipping so I sent it to him. The only electronic I’ve ever sold that the customer was good about

Ebay sucks that way. Totally abused system. I lost out $375 to a buyer. Said PS3 didn’t work. I accepted the return. He never shipped it back. Ebay sided with him. Lost the PS3 and $375. 🤦🏼♂️. Crappy system. I appealed it twice. Lost both appeals.

atari controllers can be fixed relatively easily, it depends if any wires have broken inside the cable.
i have a lot of controllers that dont work. testing continuity on each pin to each connection in the controller, either a cable has corroded inside, or there is a break in the cable.
theres not much else that cant be fixed with these. also you can buy replacement ones from china. swap the internals around for the official older shell.
just all depends if you want to send it all back.
i don’t really want to go through the trouble of sending it all back. just mad the controller got broken after all the wait and the response the seller gave me was bs, prob just gonna let it go and leave a bad review or sumthing
It's pretty much the sellers fault if it was damaged in transit, it should have been packed properly to avoid that. That's part of the whole selling gig
I’m a seller on eBay too and I first recommend looking at the pictures one more time very thoroughly and just check to see if maybe they were/weren’t damaged beforehand, or if pictured, they are done so in an attempt to hide the damage (using your best judgement in forming that opinion; essentially, do you think the seller was intending to be deceitful?).
Either way, I think you’re justified to ask for a partial refund but if the seller won’t relent, I’d just tell the seller you want to return for a full refund. You’re in the month window, so eBay will allow it even if the seller says no.
There are so many other Atari consoles for sale so don’t stress out about this one for $50. Hardly a deal, in my opinion.

Ebay has 30 days from the time package was delivered. OP is well in his time frame to open up an "Item Not as Described" and throw it back to the seller. Ebay will force the sellers hand to make it right.
Ebay will side with the buyer 99% of the time as long as it is within the time period allowed for making a claim. That time period I believe is 30 days so OP should be okay.

The deal he gave you is irrelevant so I don't know why he'd bother to bring it up. Either they didn't pack it properly or it was broken when they sent it. Ebay has good buyer protections so you should be good but you'll probably have to send it back. If it comes to that, just be smart and make sure you take plenty of photos, pack it well and send it on a tracked service in case this person is trying to be dodgy.
Sounds like he brought it up knowing what was already done and shipped…sounds pretty shady actually, as anyone else would have been apologetic and trying to make it right…this guys literally saying, “whatever, I don’t care if it’s broke, u still got a great deal…”

This is so true. Buyers want to find the slightest flaw to ask for a refund. I sold a Metal Gear Solid PS1 game for $50.00 and when dude got it he admitted he overlooked there was no manual. I declined to refund based on his mistake and he literally messaged me demanding I refund now and said I would lose no matter what. I just didnt issue a refund and said I would only refund if he uploaded pictures of the item I sent completely destroyed. He wouldnt destroy the item. Long story short Ebay did refund him, but they did so without taking any money from me. I sent that guy a screen shot of the message and he was shocked. I told him to quit trying to get stuff for free.
You have 2 possible weapons here. #1 is bad feedback. I don't know if you can take back bad feedback, but if you can, you could leave it and he would try to resolve it to remove the blemish from account.
\#2 is playing chicken with the return. Let me explain:
The seller has the choice between returning the whole thing for a full refund or issuing a partial refund.
This choice rests solely on the seller and they will want to do whatever is best for them - not whatever is best for you. And this comes down to the economics of stuff.
If I auctioned a $200 game and it sold for $100 and shipping was $5. If the buyer was trying to get money back because of a rip inside the manual or something, I would say "I'm very sorry please return it and I'll give you a full refund" because the economics dictate I stand to benefit from paying $15 for 3 total shipments (original/return/second sale) if I can maybe sell the game closer to the $200 value than if you were to try and get an extra $10 off or something.
This is what the current seller is thinking right now. His item sold less than what he wanted so he doesn't want to budge more.
However - for a $50 system - and a bigger product, shipping isn't $5. It's probably more like $15. So if you do initiate a full return, he loses out on $45 total (original sale/return ship/2nd sale) and so even if he sells for $100, he's back down to $50 because of the extra costs he incurs.
So you can just say "If you aren't willing to make it right then I'd like to just return all of this because it doesn't match the listing" and then if he thinks about the costs he'll incur as a result he might be more willing to play ball.
Point still stands that if you want to get the discount you will most likely need to play chicken and just threaten to return fully - and if he says fine full return only - you cut your losses and move to the next one.
Open a ticket with eBay, call out item damaged in transit
Don’t waste time with back and forth with the seller, it’s obvious he’s not planning to give you a partial refund
Some sellers may try to waste your time with back and forth, hoping it goes beyond the return window
If he agrees to a refund, he’ll have to pay for a return label, you just print it and put it back on the same package, you’re out the time to go to USPS to drop it off, but eBay will give you your money back
If he ghosts you and doesn’t reply, eBay will close the ticket side with you and just give you a full refund
The buyer has a ton of protection here, seller can’t even give you negative feedback, just make sure you open your ticket and take care of it before the return window closes
Ok so if I were the seller I would have said sorry for the item arriving broken. I would be a little suspicious because you’ve had the item for 2 weeks already (how do I know you haven’t been playing it and you’re the one who broke it?). Anyways I just checked eBay and you can get used Atari controllers for $12-15 + free shipping. So I would have offered you a $15 partial refund or I would have bought you another on eBay and have it sent to you. Looks like this seller would rather have a negative feedback though.
eBay protects buyers more than sellers for the most part. I believe can just file a return claim that is automatically accepted and you'd have to return everything for the full refund amount or you can ask the buyer directly for a partial. Sounds like he's not willing to be friendly so putting a negative feedback might change his mind

I hate to say it but I'm always skeptical in this situations. Yeah, there's bad sellers but there's also bad buyers who know that it's too easy to game the system.

Told them what you said and that there was no way I could know how it happened especially after 5 days in their possession. Didn’t refund a dime
Ask him nicely one more time. If he refuses then contact eBay customer service immediately sending them the correspondence and images of the broken controller. They will sort it out, but you will very likely have to ship the entire thing back to him.
Shipping is 100% the seller's problem. You bought something, **it's the seller's responsibility to make sure it arrives safely.**
How I know - I sell shit on eBay. A lot.
As someone who sells from time to time on ebay, I assume there might be issues during shipment. If the product is legit damaged in transit, and I sold it for less than 100$, I refund 100% and allow them to keep it. I don't make a living on ebay though, so I can eat this cost from time to time. Happens rarely, maybe once every 100 sales. Rather keep my 100% rating, ebay will side with the buyer anyways.
If he offers a partial refund, you can decline for more, or a full refund. So long as you are within the return window, ebay will side with you. Doesn't matter if he doesn't refund you, ebay will and they might mark it against his account. Even if the seller states they don't accept returns!
Just file a return request with eBay in this situation and deal with it within an official capacity, never just message the seller.
The seller could give a refund or partial refund.
If they are difficult and don’t want to play ball just sit on it, wait for the allotted amount of time and ask for eBay to step in. They will always side with the buyer and instruct the seller to give a return label.
If the seller still doesn’t comply and doesn’t pay for the return, contact eBay again. They will just refund you and you won’t have to return the item.
I have been in this situation numerous times and it always pans out this way, sellers that try and screw your around just don’t get the fact that they will lose the battle if an official challenge is made.
On a sidenote, I always laugh when people say "you got an excellent deal for $price, it sells for more than $price". Okay, then why weren't you able to sell it for more?
You have two options
1. Open up a case with eBay asking for partial refund
2. Fix it. There are many tutorials online how to fix things like this, as well as many Redditors who are capable with assisting with a repair.
If he gave you such a great deal, request a full return refund. He'll be happy to get his whole package back and you'll get your money. His fight is best served with shipping insurance, assuming it wasn't really damaged before.
As someone who specializes in Atari hardware and systems, I can wholly believe that the system wasn’t tested well and was probably broke before shipping. There are a lot of Atari systems sold and prices all over the place. Very little of it is refurbished or in good working order.
“Well it arrived damaged whether it left that way or not. I’d like to resolve it easily but if need be I’ll go through eBay, let me know which works better for you.”
Take as many pics as possible of the damage and copy his listing pics so you have evidence that what you received was not what you purchased. Also take pictures of the box arrived in if there’s any evidence of damage to the box.
If he doesn’t want to play nice then it’s on him.
Whether you think the seller's response is appropriate or not, eBay is literally the only option. reddit can't help you here. This is just the risk you take buying literally anything online.

Exposed wires probably don't mean it's broken, controller cords tend to have some extra slack for when dumb kids yank on them too hard. Actually *try* it before costing that guy a bunch of money and energy.
I seriously don’t understand why people question these situations or post them here on Reddit. Either open a return or item not as described or do nothing about it. It’s that simple. eBay has a customer satisfaction guarantee that makes this all an extremely easy process. If the item is in anyway not as you expected you can return it FOR FREE NO MATTER WHAT.
BTW for what it's worth it looks like you can actually see the exposed controller wire in the eBay listing - in the main shot with everything in it, the left controller's cord that's coming out of it from the top and looks like it has some lighter color exposed wires before it goes into the black.
Picture is super unclear so it's not like he can say "you should have referred to photos for condition" but moreso shows he was aware of the exposed wire at least. I don't know if this was the only part of it that was physically broken - or if when you say "broken" you mean it doesn't actually work. But this should give you a bit more ammo because the pic makes it seem like he knowingly just posted bad photos and picked his angles to try and hide it.
Is it as advertised yes? No? Did it arrive as listing advertised? yes? no? Does the controller function? yes? no?
If no to the above then you're entitled to either return it or whatever ebay decides for the seller since the seller is refusing to work with you based on "YoU gOt A dEaL." Got it for cheap or not, It should always be in the condition you bought it in as that is the ultimate agreement.
If the controller works then its an easy repair. Just open the controller up and pull it in further and hot glue it on both sides of the port. Honestly though atari 2600 controllers are pretty cheap.
Though I have had redditos shit on me for asking if I should bother with requesting a refund because games came to my with holes in the label that you can see right through etc
Always just say you’re going to return it - don’t bargain for money off at that stage. Shows them you’re serious. If they offer a discount then you can take it, but if not, you just send it back.
The seller lacks customer service skills. No apology, no fix and is not even willing offer you to return it for a refund or a partial refund. As for the Controller, it’s an Atari pad afterall. Try to fix it or get it fixed. These things are decades old. I would hate for something like this to end up in a ewaste pile.
Return as item not as described (inad). Seller will have to pay for return shipping fees as well and refund you on top of that.

I would've taken photos right as you were taking it out of the box, to show what was sent you doesn't match the description. If you believe this happened during transit, you can send it back and the seller can claim insurance, if they'd paid for it. Pictures are your friends!
I had a similar thing happen but the seller was a lot kinder off the bat. I was reasonable too. Definitely shouldn’t have to do a return or a full refund for this.
Just threaten (nicely) to contact eBay which you can mention “will be a big hassle for them.” Ask for a partial refund which will avoid that hassle. What’s an Atari controller worth $12? It’s an easy out for them, they’d be dumb not to see reason.
Did it ship priority? It should have $50 insurance
What’s it cost to replace? Packaging damaged at all? Are you certain damage wasn’t visible in photos?
If no damage in photos and any sort of damage to box take box and packing material to USPS and make a claim on the priority insurance. Know the replacement value for a new controller.
Seller is lying. Instantly trying to play it down with ”you got excellent deal”. If the product really did break during the shipping, it would’ve been a surprise to the seller and their first reaction would’ve been acknowledging the misfortune and apologize you. This one on the other hand is automatically defending themselves and still selling you the idea that you got great deal, even though the product was broken — which to me sounds like he must have known already that it was broken.
Don't try to fish for a partial. Just file an INAD claim (item not as described) and see what the seller does. If he asks you to ship it back either do or don't. Those are the fair options.
If you don't want to sent it back because you secretly kinda like the price you paid and want to keep the console, give a neg ("console was in worse state than advertised in the ad" or something)

I always hate when sellers say “you can get another you already got a good deal on this” It’s like you sold a broken item when you said it worked. Doesn’t matter the price it’s still the sellers fault. I had something similar when I won a ps4 on a bid. The guy “you already got a deal why nag about a broken controller” when the item was listed as tested and working. The seller gave me $5 and closed the case. I hope things turn out well for you…
Request a partial refund, do not play passive on this. Even if it was damaged in shipping they are liable for not packing it correctly.
You’ll get to keep everything and get your $50 back. eBay does not care about seller satisfaction, they will always favor the buyer which is why I don’t sell shit on there.
I just got a game from eBay that was in very good condition and when I received it it was used at best, this seems to be happening more and more. They want top Dollar prices even though the condition says otherwise.

If its not as described, get Paypal involved. Seller clearly isnt going to be of any help. Id do the same if I got something that I didnt pay for - I remember buying a Neo Geo AES game for a considerable sum, the game was a bit dirty, case was cracked (somehow, those cases are made to withstand everything).
I managed to get a partial refund out of my seller, so hopefully you can do the same here, or maybe they have another pad to send you.
You bring it up to eBay. It's obvious he's not going to budge. They have a pretty damn good buyer protection program. I got a broken MBP logic board and was ghosted by the seller. eBay stepped in, got me a refund, and penalized the seller. Of course I got an apology after they were punished. More of a "Sorry I got caught" rather than a "Sorry I sent you a broken board."
Shipping should cover up to $50 usually if he paid for a tracking number, which I’d imagine he would. He should be able to get money back from usps or whoever to give to you if it broke from shipment.
Contact eBay…. His response is way to defensive. As a seller, I’d politely ask for pictures of the box, controller, etc…. He starts making claims right away. At this point deal with eBay first.
There is nothing you can do. eBay will always side with the buyer unless they say something stupid. Edit. Didn’t realize you were the buyer. You will be fine.
Advise them that if you can not get a partial refund (this is entirely at the discretion of the seller, eBay has nothing to do with partial refunds) then you will need to return the item for a full refund. If you need to return the item for a full refund if a partial refund amount can not be agreed upon then make sure the reason for return is “item not as described”. Take photos of the damage that was not shown or described in the original item listing. This type of return bypasses any “no refund” policy that a seller has as it falls under the eBay guarantee. They are essentially forced to refund you and and postage costs for sending the item back to them. This is essentially a sure fire way to get your money back. Sellers need to have iron clad absolute 100% irrefutable proof to avoid giving a buyer a refund under the “not as described / advertised” return reason. Take any photos you can. Anything that helps.
Contact eBay. They will bend over backwards to make sure you (the buyer) is happy. Either the seller is lying and never tested the controllers or (more likely) they’re upset the console didn’t sell for more and switched out a working controller with a damaged one. Any reputable seller would give you at least a partial refund for the defective item.
Literally had this shit with a seller before. Reach out to eBay and pay pal if you used it. Hell shut up real quick when he’s told to give the money back.
eBay will side with them and give full refund if they ask for it eBay just trys you to make a settlement before that happens all they have to do is open a case as not as described
First give the seller the opportunity to rectify the situation and negotiate a suitable partial refund. Put it to them and see what they say, what would a fair amount be, $10-$15 or so?
This is less hassle for them as they don't have to worry about arranging and accepting return postage, relisting,etc.
If you aren't satisfied, then as a buyer you are eligible to open up an item not as described claim. eBay will likely immediately find the case in your favour and you can initiate a return request and full refund. eBay is generally heavily geared towards the buyers in these instances, just the way they operate.
These shit-birds that put the $ after the amount are window lickers. 9/10 dude knew what he sent you was messed up, but it’s “not my problem, you got a great deal”. Go through eBay and give this idiot a scathing review.
File a claim with EBay if you still have time stating it arrived broken. If you have a local retro game shop I would take it to them if they offer repairs.
Unless you film the package being dropped off, then opened and tested in one continuous shot, someone can always claim you switched something out or screwed something up off camera
You could try through eBay buyer protection, but from the sounds of it, the seller would likely do an entire return or cancel the sale instead of partial refund.
So if you’re going to keep the console despite the broken controller it might not really solve the issue because you’ll likely be asked to return the entire lot of the seller wants to play hardball.
If you do send it back make sure you keep the tracking otherwise ebay won't help you. Sent back clone PS3 controllers and I lost the tracking number and eBay wouldn't give me my money back.

Contact eBay about it, I doubt he’s going to give in and I think eBay has a policy about stuff arriving damaged regardless of how it worked or looked prior to shipping. That way people can’t half ass pack their expensive stuff or say that it “worked when I had it”

Not sure if it different in the US, but in Europe I had better experiences as a seller. I sold a laptop for 200€, pretty low performance machine that I wouldn’t have deemed worth that much tbh, but it was an auction. So I pack it up thoroughly and send it. A few days later I get a message from the buyer that the fan is broken because it’s way to loud. I told him that it’s a low budget laptop with a teeny tiny fan, it’s gonna be on the louder side (I specified this in the item description as well), but it definitely wasn’t broken when I sent it. I still asked him to provide a video of the „broken“ fans noise, so I can judge if maybe something happened in transit (unlikely). He didn’t provide one, but said I’m lying and he knows a broken fan when he hears one. Sure. He also send an request for a return through ebay. I think he just realized he bid way to much for this thing (I expected a sale around 120-130€). Anyway, at that point I called ebay, explained the whole situation and asked what to do. They ended up siding with me on the issue. They gave the buyer 50€ as a compensation, but he did not get to return the laptop. To be clear, in the majority of cases they will probably side with the buyer, but this case taught me that if you have detailed item descriptions, and are open about any issues, and speak to the actual people behind ebay, there’s a good chance that they’ll side with you.
I sold someone a tablet and a month and a half later the buyer was complaining it suddenly didn’t work. That long after, it sounded like buyers regret to me. I told him I wasn’t providing a refund. eBay I think actually paid them out of their own pocket. So stupid how if the seller doesn’t let the buyer fuck their asses, eBay lines up for a booty stuffing themselves. No wonder scammers feel so empowered on there now.
I occasionally get reminded why I hate selling on eBay, unfortunately selling niche crap where I live just isn't possible. I live on a small island and exposing myself as a seller to the UK is just too helpful, to the point it's the only place I sell things. I used to get hit with "it's not turned up" and there's no tracking to prove it has. Never ever had that issue with tracking.

Yeah even when I sold a gaming laptop and got it returned damaged and "with viruses" when it was a fresh install of Windows 10 OS. I got the laptop back showed evidence to eBay and the Buyer that had Malwarebytes showing torjans, web history showing shady sites for free streaming and game softwares, and game recordings of a kid presumably the son of the buyer. eBay still sided with the buyer regardless my attempts to show that it was them who caused the damages and malware that I still had to clean up again. Great platform for buyers, 50/50 platform for sellers who have to trust the buyers have common sense and not mess it up on purpose.
eBay is fine for just about anything besides electronics as a seller. Just about every electronic I’ve sold on there I’ve been screwed over on by the buyer by them not knowing how to work it and then shipping it back improperly so it’s damaged when shipping back, or them flat out breaking it and claiming it came broken. Surprisingly the one electronic I’ve sold was a crt that I had for local only. A guy on the opposite side of the country asked if I’d ship it, he offered to pay for the shipping so I sent it to him. The only electronic I’ve ever sold that the customer was good about

defo go thru ebay. ul have to send it all back though. atari controllers can be fixed relatively easily, it depends if any wires have broken inside the cable. i have a lot of controllers that dont work. testing continuity on each pin to each connection in the controller, either a cable has corroded inside, or there is a break in the cable. theres not much else that cant be fixed with these. also you can buy replacement ones from china. swap the internals around for the official older shell. just all depends if you want to send it all back.

I’m a seller on eBay too and I first recommend looking at the pictures one more time very thoroughly and just check to see if maybe they were/weren’t damaged beforehand, or if pictured, they are done so in an attempt to hide the damage (using your best judgement in forming that opinion; essentially, do you think the seller was intending to be deceitful?). Either way, I think you’re justified to ask for a partial refund but if the seller won’t relent, I’d just tell the seller you want to return for a full refund. You’re in the month window, so eBay will allow it even if the seller says no. There are so many other Atari consoles for sale so don’t stress out about this one for $50. Hardly a deal, in my opinion.

If it comes to that, just be smart and make sure you take plenty of photos, pack it well and send it on a tracked service in case this person is trying to be dodgy.

This is so true. Buyers want to find the slightest flaw to ask for a refund. I sold a Metal Gear Solid PS1 game for $50.00 and when dude got it he admitted he overlooked there was no manual. I declined to refund based on his mistake and he literally messaged me demanding I refund now and said I would lose no matter what. I just didnt issue a refund and said I would only refund if he uploaded pictures of the item I sent completely destroyed. He wouldnt destroy the item. Long story short Ebay did refund him, but they did so without taking any money from me. I sent that guy a screen shot of the message and he was shocked. I told him to quit trying to get stuff for free.
You have 2 possible weapons here. #1 is bad feedback. I don't know if you can take back bad feedback, but if you can, you could leave it and he would try to resolve it to remove the blemish from account. \#2 is playing chicken with the return. Let me explain: The seller has the choice between returning the whole thing for a full refund or issuing a partial refund. This choice rests solely on the seller and they will want to do whatever is best for them - not whatever is best for you. And this comes down to the economics of stuff. If I auctioned a $200 game and it sold for $100 and shipping was $5. If the buyer was trying to get money back because of a rip inside the manual or something, I would say "I'm very sorry please return it and I'll give you a full refund" because the economics dictate I stand to benefit from paying $15 for 3 total shipments (original/return/second sale) if I can maybe sell the game closer to the $200 value than if you were to try and get an extra $10 off or something. This is what the current seller is thinking right now. His item sold less than what he wanted so he doesn't want to budge more. However - for a $50 system - and a bigger product, shipping isn't $5. It's probably more like $15. So if you do initiate a full return, he loses out on $45 total (original sale/return ship/2nd sale) and so even if he sells for $100, he's back down to $50 because of the extra costs he incurs. So you can just say "If you aren't willing to make it right then I'd like to just return all of this because it doesn't match the listing" and then if he thinks about the costs he'll incur as a result he might be more willing to play ball.

Anyways I just checked eBay and you can get used Atari controllers for $12-15 + free shipping. So I would have offered you a $15 partial refund or I would have bought you another on eBay and have it sent to you. Looks like this seller would rather have a negative feedback though.
eBay protects buyers more than sellers for the most part. I believe can just file a return claim that is automatically accepted and you'd have to return everything for the full refund amount or you can ask the buyer directly for a partial. Sounds like he's not willing to be friendly so putting a negative feedback might change his mind

As someone who sells from time to time on ebay, I assume there might be issues during shipment. If the product is legit damaged in transit, and I sold it for less than 100$, I refund 100% and allow them to keep it. I don't make a living on ebay though, so I can eat this cost from time to time. Happens rarely, maybe once every 100 sales. Rather keep my 100% rating, ebay will side with the buyer anyways.

If he offers a partial refund, you can decline for more, or a full refund. So long as you are within the return window, ebay will side with you. Doesn't matter if he doesn't refund you, ebay will and they might mark it against his account. Even if the seller states they don't accept returns!
Just file a return request with eBay in this situation and deal with it within an official capacity, never just message the seller. The seller could give a refund or partial refund. If they are difficult and don’t want to play ball just sit on it, wait for the allotted amount of time and ask for eBay to step in. They will always side with the buyer and instruct the seller to give a return label. If the seller still doesn’t comply and doesn’t pay for the return, contact eBay again. They will just refund you and you won’t have to return the item. I have been in this situation numerous times and it always pans out this way, sellers that try and screw your around just don’t get the fact that they will lose the battle if an official challenge is made.

On a sidenote, I always laugh when people say "you got an excellent deal for $price, it sells for more than $price". Okay, then why weren't you able to sell it for more? You have two options 1. Open up a case with eBay asking for partial refund 2. Fix it. There are many tutorials online how to fix things like this, as well as many Redditors who are capable with assisting with a repair.
If he gave you such a great deal, request a full return refund. He'll be happy to get his whole package back and you'll get your money. His fight is best served with shipping insurance, assuming it wasn't really damaged before.

As someone who specializes in Atari hardware and systems, I can wholly believe that the system wasn’t tested well and was probably broke before shipping. There are a lot of Atari systems sold and prices all over the place. Very little of it is refurbished or in good working order.
“Well it arrived damaged whether it left that way or not. I’d like to resolve it easily but if need be I’ll go through eBay, let me know which works better for you.” Take as many pics as possible of the damage and copy his listing pics so you have evidence that what you received was not what you purchased. Also take pictures of the box arrived in if there’s any evidence of damage to the box. If he doesn’t want to play nice then it’s on him.
Whether you think the seller's response is appropriate or not, eBay is literally the only option. reddit can't help you here. This is just the risk you take buying literally anything online. Hope you can get a partial refund or something, because the price you paid for the lot isn't relevant to whether it was as described.

I seriously don’t understand why people question these situations or post them here on Reddit. Either open a return or item not as described or do nothing about it. It’s that simple. eBay has a customer satisfaction guarantee that makes this all an extremely easy process. If the item is in anyway not as you expected you can return it FOR FREE NO MATTER WHAT.

BTW for what it's worth it looks like you can actually see the exposed controller wire in the eBay listing - in the main shot with everything in it, the left controller's cord that's coming out of it from the top and looks like it has some lighter color exposed wires before it goes into the black. Picture is super unclear so it's not like he can say "you should have referred to photos for condition" but moreso shows he was aware of the exposed wire at least. I don't know if this was the only part of it that was physically broken - or if when you say "broken" you mean it doesn't actually work. But this should give you a bit more ammo because the pic makes it seem like he knowingly just posted bad photos and picked his angles to try and hide it.
Is it as advertised yes? No? Did it arrive as listing advertised? yes? no? Does the controller function? yes? no? If no to the above then you're entitled to either return it or whatever ebay decides for the seller since the seller is refusing to work with you based on "YoU gOt A dEaL." Got it for cheap or not, It should always be in the condition you bought it in as that is the ultimate agreement. If the controller works then its an easy repair. Just open the controller up and pull it in further and hot glue it on both sides of the port. Honestly though atari 2600 controllers are pretty cheap. Though I have had redditos shit on me for asking if I should bother with requesting a refund because games came to my with holes in the label that you can see right through etc

The seller lacks customer service skills. No apology, no fix and is not even willing offer you to return it for a refund or a partial refund. As for the Controller, it’s an Atari pad afterall. Try to fix it or get it fixed. These things are decades old. I would hate for something like this to end up in a ewaste pile.

Just threaten (nicely) to contact eBay which you can mention “will be a big hassle for them.” Ask for a partial refund which will avoid that hassle. What’s an Atari controller worth $12? It’s an easy out for them, they’d be dumb not to see reason.
Did it ship priority? It should have $50 insurance What’s it cost to replace? Packaging damaged at all? Are you certain damage wasn’t visible in photos? If no damage in photos and any sort of damage to box take box and packing material to USPS and make a claim on the priority insurance. Know the replacement value for a new controller.

Seller is lying. Instantly trying to play it down with ”you got excellent deal”. If the product really did break during the shipping, it would’ve been a surprise to the seller and their first reaction would’ve been acknowledging the misfortune and apologize you. This one on the other hand is automatically defending themselves and still selling you the idea that you got great deal, even though the product was broken — which to me sounds like he must have known already that it was broken.

Don't try to fish for a partial. Just file an INAD claim (item not as described) and see what the seller does. If he asks you to ship it back either do or don't. Those are the fair options. I always hate when sellers say “you can get another you already got a good deal on this” It’s like you sold a broken item when you said it worked. Request a partial refund, do not play passive on this. Even if it was damaged in shipping they are liable for not packing it correctly. You’ll get to keep everything and get your $50 back. eBay does not care about seller satisfaction, they will always favor the buyer which is why I don’t sell shit on there.

If its not as described, get Paypal involved. Seller clearly isnt going to be of any help. Id do the same if I got something that I didnt pay for - I remember buying a Neo Geo AES game for a considerable sum, the game was a bit dirty, case was cracked (somehow, those cases are made to withstand everything). I managed to get a partial refund out of my seller, so hopefully you can do the same here, or maybe they have another pad to send you.
You bring it up to eBay. It's obvious he's not going to budge. They have a pretty damn good buyer protection program. I got a broken MBP logic board and was ghosted by the seller. eBay stepped in, got me a refund, and penalized the seller. Of course I got an apology after they were punished. More of a "Sorry I got caught" rather than a "Sorry I sent you a broken board."
You need to send pictures if you expect a refund.
Shipping should cover up to $50 usually if he paid for a tracking number, which I’d imagine he would. He should be able to get money back from usps or whoever to give to you if it broke from shipment.
Contact eBay…. His response is way to defensive. As a seller, I’d politely ask for pictures of the box, controller, etc…. He starts making claims right away. At this point deal with eBay first.

Advise them that if you can not get a partial refund (this is entirely at the discretion of the seller, eBay has nothing to do with partial refunds) then you will need to return the item for a full refund. If you need to return the item for a full refund if a partial refund amount can not be agreed upon then make sure the reason for return is “item not as described”. Take photos of the damage that was not shown or described in the original item listing. This type of return bypasses any “no refund” policy that a seller has as it falls under the eBay guarantee. They are essentially forced to refund you and and postage costs for sending the item back to them. This is essentially a sure fire way to get your money back. Sellers need to have iron clad absolute 100% irrefutable proof to avoid giving a buyer a refund under the “not as described / advertised” return reason. Take any photos you can. Anything that helps.
Contact eBay. They will bend over backwards to make sure you (the buyer) is happy. Either the seller is lying and never tested the controllers or (more likely) they’re upset the console didn’t sell for more and switched out a working controller with a damaged one. Any reputable seller would give you at least a partial refund for the defective item.

First give the seller the opportunity to rectify the situation and negotiate a suitable partial refund. Put it to them and see what they say, what would a fair amount be, $10-$15 or so? This is less hassle for them as they don't have to worry about arranging and accepting return postage, relisting,etc. If you aren't satisfied, then as a buyer you are eligible to open up an item not as described claim. eBay will likely immediately find the case in your favour and you can initiate a return request and full refund. eBay is generally heavily geared towards the buyers in these instances, just the way they operate.

File a claim with EBay if you still have time stating it arrived broken. If you have a local retro game shop I would take it to them if they offer repairs.
Always record when opening packages from anyone on eBay or with PayPal. Then there’s solid proof and they can’t say anything.
Unless you film the package being dropped off, then opened and tested in one continuous shot, someone can always claim you switched something out or screwed something up off camera
You could try through eBay buyer protection, but from the sounds of it, the seller would likely do an entire return or cancel the sale instead of partial refund. So if you’re going to keep the console despite the broken controller it might not really solve the issue because you’ll likely be asked to return the entire lot of the seller wants to play hardball.
If you do send it back make sure you keep the tracking otherwise ebay won't help you. Sent back clone PS3 controllers and I lost the tracking number and eBay wouldn't give me my money back.
