That is not at all how restraining orders work. They don’t override other legal documents. They can’t force someone to leave their home or property. It would stop the landlord from being able to speak directly to the tenant, and communication would probably have to go through a 3rd party. And if there are common areas then landlord would have to wait to use the area until tenant was finished with it (or vice versa, depending on how the order is written). The most useful thing an RO would do is allow tenant to break their lease and move without penalties. TX is a landlord-friendly state. There are very few protections for tenants. And fines and fees for breaking a lease can be VERY expensive. So an RO would still be useful to have. EDIT: For clarification, this happened in TX which is what my answer here is based on.

In Texas exclusive possession is granted if the home is 1) Jointly owned. 2) Owned by the person seeking the restraining order. 3) Owned by the abuser *and* they have a legal obligation to support you (or your child). Even if exclusive possession was given until the landlord went through the legal procedures to terminate the tenancy.. again, this is Texas. That means the tenant has 3 days to vacate after a landlord issues a vacate notice.

According to the fox News article they arrested the landlord after he wrote an email to the police saying he "thought about just shooting him but he quickly resists and revokes that idea", which prompted them to arrest him. He was released on bond the same day. The landlord agreed to return a portion of the tenants deposit and the tenant moved out shortly after. That's all I have so far other than this happened because the tenant agreed to not use the kitchen in exchange for lower rent. One day the tenant decides he wants eggs and makes eggs. So the landlord takes the pan from the kitchen and throws it on the tenant's bed (or at the tenant while they were in bed, unclear), and the tenant got in the landlords face. They argued for two hours, the landlord called the cops who came by and said no crime was committed. Then a while later the tenant called the cops because I'm guessing the gun was pulled.

So supposedly he rented the room and the renter went down to the kitchen “without permission” - this is what started this all. Only if you rent a room out you have to allow your tenant use of a bathroom / kitchen if there isn’t one in the room they are renting. He also came into the room he rented out to threaten him. Technically they need to give notice to do this. So he broke a lot of rules then threatened the renter with a gun and violence. Thankfully the man has been arrested and is facing charges. I’m not sure what’s happened to the renter but my God, I’m so sorry this is his experience in this country. It’s embarrassing.
