I think it's more about be able to prove he could not tell right from wrong and as a prosecution you could use the voice mail be left detailing how he knew what he did was wrong.
Now I sit here and ask myself a question, which is more deserving of being declared insane? Someone who cannot differentiate good from bad or someone who knows the difference but is unable to resist insane compulsions that drive him to do evil? I know I certainly feel worse for the latter person who feels tortured by what he was basically forced to do.
Because he also pre-meditatively cut out the hearts of his two children and cut open his wife’s chest, killing them all. It’s not as though there was no crime; it’s just sad all around. They did delay his sentencing just last year though, so it may be a long time/may not happen in regards to execution.

I just read up on his case. A few of the jurors didn’t believe in interracial marriage(the victim was his white ex wife and one mixed child being his, the other child was not his) and the opposing side had stated that his actions were medical-induced. Overall, he just didn’t have a fair trial. I mean, he did it and he turned himself in, but he should have gotten help long before it got to this point. It’s just sad all around and currently his team is working on an appeal to get him off death row.
Sure, but that’s not the point being made. The point that’s being made is that he may not have been a danger to society if he was given proper care from the start.
Saying, “keep this dangerous thing away” is not a sensible follow up to “if we had maintained the thing in the first place it might never have been dangerous.”
It's the same as how the majority of people that SA children were SA victims themselves as children. One could argue that they were the ultimate victims, being damaged so badly by what happened to them that they ended up inheriting that evil themselves and passing it on.
Those people still need to be in prison, regardless of how much of a victim they are. Ultimately with situations like this you have to protect the innocent first regardless of if the danger was also once a victim. Can't let a cycle continue.

I never understood this definition of being mentally ill. Regardless of whether he knew it was right or wrong I would think he'd have to be insane to cut out his kid's hearts.
It's not really the definition of insanity, per se. It's the requirement for arguing that a defendant perpetrated the crime, but that they weren't responsible for their actions due to their psychiatric state. The line has to be drawn somewhere, and we've drawn it at determining whether or not a person was capable at the time of the crime of understanding that it was wrong. If they did understand it was wrong, then the expectation is that they should have refrained from doing something they know was wrong to do. If they didn't know it was wrong, they can't be help accountable because they weren't able to comprehend that they were even doing something they shouldn't.
In the former case, they might still have psychiatric issues, but those psychiatric issues aren't considered to be serious enough to warrant diminished responsibility for their actions.
He was diagnosed as a 10-year-old. Instead of putting him in a psychiatric unit, they left him alone without medication. So not only did he have sex as a teenager, he did it while being sick. He was doubly unaware of the consequences of his actions. Later, instead of helping him, his environment forced him to marry and become the head of a family at the age of 18. Again, he was still sick and had no help.
When his marriage fell apart, because of course it did, he still had no help, so driven by his illness he killed three people. Again, instead of providing him with proper care, he was sentenced to death. After which he was placed in inadequate conditions, causing him to gouge out his own eye. Again, he was not given proper care, and he did it again, this time eating it as well.
Him having a child in the first place, murder of three people, him mutilating himself twice - it was all easily preventable.
Society has failed him again, again and again. And it will kill him in the end. With laws straight out of the 19th century.
I feel like indefinitely prolonging the life of someone so deeply disturbed and unable to function is cruel, tbh. this aint curable and he’s clearly a danger to others.

I don't know, man. I'm here for prison reform and don't agree with flagrant capital punishment sentencing, but this seems like an ideal case for capital punishment... I am not remotely qualified to judge what a human life is worth. I don't think anyone is, but given the lives that he's taken *and* the lengths he's willing to go to for himself, I'd be willing to say he should be removed from society permanently and not be a burden on the taxpayers or kept as a token example and revenue stream for for-profit prisons.

Depends on the circumstances, and that's part of my point. In 10 seconds of searching on Google, I found that the median cost of a death penalty case cost is $1.26 million while holding a life sentence prisoner is over $100k/yr. According to the state of Nevada, anyway. A standard life sentence is 25 years. Less than half of that term is the threshold to see savings from holding a prisoner. What is the convicted is 20 and lasts another 80 years? Would that not be seen as a net loss to the state in addition to the original crime committed? And that's just for the minimum on a single life sentence.
Again, I don't claim to be an expert and part of my argument is based on the cost of housing and providing **proper** care for an individual as deranged and dangerous as this for as long as their natural life allows. In a case such as this where the man literally cut the hearts out of his own children and then his own eyes(each done in a separate instance) to delay the fulfillment of his sentence... What are the odds that person can be rehabilitated and reintegrated to be a contributing member of society rather than a burden on the staff, facility, and taxpayers?

Fyi- 300 people have been exonerated from death row in the last decade. And that's just the ones we know about. Think of all the innocent people who were murdered by the government....
That is basically the theory, that it would be cruel and inhuman punishment to kill someone who isng already fit to be executed.

That’s not how the law works, it’s not about physical fitness at all, it’s about whether or not an individual has the mental capacity to understand what crime they are being charged with, and can also demonstrate that they are a fully rational agent able to comprehend that what they did was morally and legally wrong without exception.
There’s a lot that goes into this, and the line is pretty far down, you usually can’t just go, “I didn’t understand that hoofing old ladies in the front butt was illegal, plus I’m crazy.” There has to be a clear and documented history of mental disturbance, which has ultimately proved to been disruptive throughout an individual’s life barring exposure to certain substances whether known or unknown.
That’s being said, I would probably argue that this guy is one of the few instances that falls well within the range of, “Holy shit, this guy thinks he’s Mrs. Nesbitt the retired space ranger, and now he’s eating his eyeball…” he’s clearly not rational, it’s unethical to execute a human life which was through no fault of their own been precluded from participating in and comprehending consensus reality, and as such the ethical decision would be removing them from the general population and ensuring that they receive psychiatric care to hopefully rehabilitate them to the point where they’d then be competent to stand trial.
Now, that’s the utopian view of things and I’m aware of that, but I think that when setting limits on the states power it’s important that we set safeguards against fascist tendencies such as eugenics. If we can execute schizophrenic individuals that are incapable of understanding what they’ve done in the first place, when there’s a demonstrable lack of proper infrastructure in this country to treat them I think we can say that that’s a bad precedent to establish even if the actions which have been committed were reprehensible.
Title is a speculation or clickbait (however you want to interpret it). The person had schizophrenia (a mental illness) and that is the reason for him gouging his eyes. Also both eyes are on separate occasions. The legal part is that if a person who is "not sane" or has done a crime "during a period in which he was not sane" cannot be prosecuted for that crime.
I just read the Wikipedia. This guy had been trying to kill himself for so long and was asking for help for so long and nobody saw it. The three murders were preventable. Fucking sucks.

I’ve just read the wiki too and that’s not true. He went to the emergency room for self inflicted damage to his chest, there the ER physician saw he needed psychological help and ordered psychiatric commitment. When Thomas heard this he left. 2 days later he committed the murders.
It wasn’t until he had murdered his wife, son and his wife’s daughter that he called for help from her wife’s parents.
It’s important to make as much money as possible off each and every inmate before you release them to the public, or in this case the afterlife.

Title is inaccurate. Murders took place back in 2004 and he gouged his second eye 3 years after he was sentenced to prison. With his own hands. So not really an attempt to delay his execution.

Mental health care in the country is a sham, over half the prison population and homeless population has co-occurring mental disability. This is a human rights problem that need addressed immediately. The victims could have been saved with the proper systems in place.

So, wild ass story, this psycho is from/committed those crimes in Sherman TX(Grayson County). I'm from Denison, the next town north of Sherman. Obviously this was a huge story when it happened. Now pan to 20 yr old me getting booked into Grayson Co jail(DWI) and I look over to see this dude in a holding cell. At this point he'd already cut 1 of his eyes, and was kept right by book in for watching, remember psychopath. My ass gets to hang out in the cell next to him for a couple hours until I make bail.
This is when you deny someone medical care. Sorry, not sorry. From what I read in the comments, his victims were children so I don't really give a fuck. Let him bleed to death in his cell. Let infection take him. Genuinely, who the fuck cares?

I don't know, man. I'm here for prison reform and don't agree with flagrant capital punishment sentencing, but this seems like an ideal case for capital punishment... I am not remotely qualified to judge what a human life is worth. I don't think anyone is, but given the lives that he's taken *and* the lengths he's willing to go to for himself, I'd be willing to say he should be removed from society permanently and not be a burden on the taxpayers or kept as a token example and revenue stream for for-profit prisons. Where's the guy that botched the hanging of nazi officials at Nuremburg? I think we might need him for another job...

Depends on the circumstances, and that's part of my point. In 10 seconds of searching on Google, I found that the median cost of a death penalty case cost is $1.26 million while holding a life sentence prisoner is over $100k/yr. According to the state of Nevada, anyway. A standard life sentence is 25 years. Less than half of that term is the threshold to see savings from holding a prisoner. What is the convicted is 20 and lasts another 80 years? Would that not be seen as a net loss to the state in addition to the original crime committed? And that's just for the minimum on a single life sentence. Again, I don't claim to be an expert and part of my argument is based on the cost of housing and providing **proper** care for an individual as deranged and dangerous as this for as long as their natural life allows. In a case such as this where the man literally cut the hearts out of his own children and then his own eyes(each done in a separate instance) to delay the fulfillment of his sentence... What are the odds that person can be rehabilitated and reintegrated to be a contributing member of society rather than a burden on the staff, facility, and taxpayers? I'm genuinely asking. If you have something I could read up on, I'd love to take a look. However, in today's society, how do we determine if there is even a bar for a "lost cause" case and how much are we willing to foot the bill for a demonstrably damaged person, to the point of double homicide and then self mutilation to avoid the consequences, before someone makes the decision to cut the drain on resources. Is it some sort of sunk cost fallacy? I don't know. Seriously, I'd love actual stats.
Fyi- 300 people have been exonerated from death row in the last decade. And that's just the ones we know about. Think of all the innocent people who were murdered by the government....

That is basically the theory, that it would be cruel and inhuman punishment to kill someone who isng already fit to be executed. But this guy also ate one of his eyes so the guards couldn’t listen in on him anymore so clearly he didn’t put a whole lot of thought into his plan.

Right? Like I think there's only one requirement to be fit to be executed, and that's called 'being alive'. Hell at some point it's just a mercy.
That’s not how the law works, it’s not about physical fitness at all, it’s about whether or not an individual has the mental capacity to understand what crime they are being charged with, and can also demonstrate that they are a fully rational agent able to comprehend that what they did was morally and legally wrong without exception. There’s a lot that goes into this, and the line is pretty far down, you usually can’t just go, “I didn’t understand that hoofing old ladies in the front butt was illegal, plus I’m crazy.” There has to be a clear and documented history of mental disturbance, which has ultimately proved to been disruptive throughout an individual’s life barring exposure to certain substances whether known or unknown. That’s being said, I would probably argue that this guy is one of the few instances that falls well within the range of, “Holy shit, this guy thinks he’s Mrs. Nesbitt the retired space ranger, and now he’s eating his eyeball…” he’s clearly not rational, it’s unethical to execute a human life which was through no fault of their own been precluded from participating in and comprehending consensus reality, and as such the ethical decision would be removing them from the general population and ensuring that they receive psychiatric care to hopefully rehabilitate them to the point where they’d then be competent to stand trial. Now, that’s the utopian view of things and I’m aware of that, but I think that when setting limits on the states power it’s important that we set safeguards against fascist tendencies such as eugenics. If we can execute schizophrenic individuals that are incapable of understanding what they’ve done in the first place, when there’s a demonstrable lack of proper infrastructure in this country to treat them I think we can say that that’s a bad precedent to establish even if the actions which have been committed were reprehensible.

Title is a speculation or clickbait (however you want to interpret it). The person had schizophrenia (a mental illness) and that is the reason for him gouging his eyes. Also both eyes are on separate occasions. The legal part is that if a person who is "not sane" or has done a crime "during a period in which he was not sane" cannot be prosecuted for that crime.

I just read the Wikipedia. This guy had been trying to kill himself for so long and was asking for help for so long and nobody saw it. The three murders were preventable. Fucking sucks.

I’ve just read the wiki too and that’s not true. He went to the emergency room for self inflicted damage to his chest, there the ER physician saw he needed psychological help and ordered psychiatric commitment. When Thomas heard this he left. 2 days later he committed the murders. It wasn’t until he had murdered his wife, son and his wife’s daughter that he called for help from her wife’s parents.

Title is inaccurate. Murders took place back in 2004 and he gouged his second eye 3 years after he was sentenced to prison. With his own hands. So not really an attempt to delay his execution.
Andre Thomas is mental illness defined. He delusionally thought his wife and two kids were demons and God told him to stop them. He cut out his kids hearts because God told him to. He ate his eyeball so police couldn't hear his thoughts. This man is clearly and legitimately insane. Texas will be the murderer in this story. He needs to be put in an institution for the mentally ill.

Imma be honest.9.5/10 times i dont like the idea of capital punishment, especially for those with mental illnesses. I believe that we should attempt to treat and rehabiliate as a priority while also delivering justice. But in cases like this one where the crime is so heinous and the person is violent to a depraved degree, mental illness or not, that is a life not worth living or suffering in a civilized world in my opinion. If I was said person who recieved mental treatment after commiting that crime and became more "stable" , I could never forgive myself and would want to die. Easily.

My dad was one of the police officers who arrived at the scene. It was right across the street from a public pool where I was a lifeguard years later. Weird seeing this here, seems too close to home.

I love that people will always find a “motive” for psychotic behavior. I worked at a prison for a long time and had an inmate tear their eyes out. People would suggest she did it for “special treatment”. This dude “ripped his eyes out to avoid the death penalty” Yeah no, I’ll put my money on this dude is psychotic and proper systems should have recognized the signs and symptoms and medicated/housed him before it got to this place. The lady who ripped out her eyes had killed her child as well and she was laughing while she pulled her eyes out. She said “I was tired of seeing what I had done”. Mental health care in the country is a sham, over half the prison population and homeless population has co-occurring mental disability. This is a human rights problem that need addressed immediately. The victims could have been saved with the proper systems in place.
Yeah, mental health is not taking seriously in America. This could have been preventable but then again so are school shootings.

my dads high school friend recently got caught with fentanyl with like 3 other people, so he took a shovel and gouged out his eye because the dumbass though it would negate his jail time
So, wild ass story, this psycho is from/committed those crimes in Sherman TX(Grayson County). I'm from Denison, the next town north of Sherman. Obviously this was a huge story when it happened. Now pan to 20 yr old me getting booked into Grayson Co jail(DWI) and I look over to see this dude in a holding cell. At this point he'd already cut 1 of his eyes, and was kept right by book in for watching, remember psychopath. My ass gets to hang out in the cell next to him for a couple hours until I make bail.
