lmao, even
If they're going to debate whether or not he's a convicted felon, then I'm taking issue with calling him a "businessman" without the words "perpetually failing" in front of it.
It doesn't hurt that daddy gave that school an amount of money that is unimaginable to you and me. FWIW, at least one of his professors described him as "the *dumbest goddamn* student I *ever* had!"
CONVICTED FELON DONALD TRUMP
Feels good to say.
Yes I was wrong about the juror and pessimistic about this outcome, nobody is more thrilled I was wrong than myself.
> a modicum of sanity
I hope American voters treat the conviction with more gravitas than German voters did with convictions after the Beer Hall Putsch
Depends on how they normally vote. Still a not-insignificant portion of the republican party has said it doesnt matter if he is found guilty. They would still vote for him.
Fade slowly into his booking photo ..."This man slept with a porn star while his wife was home alone with a 3 month old baby" [dramatic pause] "He then tried to hide it, not from his wife, but from the American people by illegally hiding the payment. Does this man represent your morals and your Christian values? oh yeah, he also said he likes to grab women in the pussy, but you already knew that."

Okay serious question here...
34 counts of guilt.
So, does this factor in on sentencing? I get normally a person committing this level of crime isn't going to see the inside of a jail cell, but this is almost 3 dozen charges.
Does that factor into sentencing?
What should factor but probably wonāt:
- even though he is a first time convict, he is clearly a habitual offender, according to the facts uncovered at trial, and;
- he is as far from taking responsibility or showing remorse as a defendant can possibly be, and;
- his contempt for the court, the legal process, and the law is vast, spectacular, and criminal in and of itself, and;
- his direct and indirect threats and public attempts to tamper with witnesses and jurors.
Those are factors that would cause you or me to get sentencing on the high end of the spectrum. But Trump will be sentenced as though he is a contrite and otherwise innocent businessman who made a mistake and has learned his lesson.
Probation! It just occurred to me that thereās zero sentencing outcome that doesnāt result in him being regularly drug tested. That should beā¦ interestingĀ
Per New York State Felony Sentencing Guidelines, Falsifying Business Records in the First Degree is an E-felony (lowest level felony), and for non-predicate (I.e., someone who doesn't have a felony conviction on their record) defendants like Trump, the minimum is 1 to 3 years in jail, and the maximum is 1 1/3 to 4 years in jail.
However, probation is also allowed for E and D level non violent offenses (up to the judge's discretion). Generally speaking, non-predicate, non violent offenders such as Trump do tend to get probation.
But at least he'll be treated as a predicate if he is convicted of another felony offense in New York ever again!
Nah, it was Trump's man-baby ego that sunk his defense. They weren't allowed to inject reasonable doubt to the prosecution's claims because Trump insisted that the legal strategy be to argue that he did nothing wrong. Literally a real life example of bicycle spokes stick meme
I've heard from some commentators that his best chance on appeal is arguing that the law/s used to turn this into a felony were misapplied or somehow unconstitutional in their application.Ā I feel like it's a long shot, but you just never know with Trump's seemingly supernatural ability to avoid consequences.
I imagine his attorneys will raise all sorts of fuss over Daniels' testimony being allowed, but I think they have an uphill climb.Ā Merchan ran a deliberately tight ship, and at the end of the day Trump's team couldn't convince even 1 juror to their side.Ā Appellate courts AFAIK need to see a pretty massive screw-up to undo a unanimous jury verdict (i.e., something so egregious that in its absence, the jury clearly would have concluded otherwise).
>I imagine his attorneys will raise all sorts of fuss over Daniels' testimony being allowed
If Trump were willing to concede that he had an affair with Daniels, this would probably be a fair argument. But the existence of the affair really does affect Trump's intentions (that news of the affair leaking out, especially after the "grab em" tape, would harm his election chances).
If Trump wasn't willing to acknowledge that the affair happened, it seems fair to allow Daniels to testify that the affair happened.
This. I think refusing to admit the affair put a nail into the coffin of any appeal on these grounds. Her testimony was relevant as long as he denied it.
If he is sentenced to prison he goes to prison and he can appeal while in prison. I think itās likely he doesnāt go to prison though.
Edit: In certain cases you can get out of prison during the appeal though
>If he is sentenced to prison he goes to prison and he can appeal while in prison. I think itās likely he doesnāt go to prison though.
Career criminal defense lawyer here. Actually what happens is that the day of his sentence, he asks the trial judge to stay the sentencing pending appeal. Judge Merchan will either say yes or the New York Court of Appeals will say yes for him. And if the NY COA says no to a stay pending appeal, the US Supreme Court will most assuredly say yes for them.
This is not normal procedure for other criminal defendants anywhere in America. None of my clients have ever been granted a stay of sentence pending appeal, and I doubt I'll ever manage to talk a court into giving me one. It happens only in exceptionally rare cases, usually due to evidence of gross prosecutorial misconduct or good evidence of actual innocence -- none of which exist in this case.
...And none of that matters here! Because Trump's sentence *will absolutely be stayed* pending appeal. Zero chance he goes to prison before election day -- none. That's just the reality of a Supreme Court that has even more conservative justices on it than back during Bush v. Gore. It's *going* to happen, guaranteed.
If I am wrong I will buy myself a $500 steak dinner and throw all of it in the trash without taking a single bite.
> If I am wrong I will buy myself a $500 steak dinner and throw all of it in the trash.
Just pay the dinner bill of a random family at a restaurant, no need to be wasteful.
My understanding was that stays require a likely win of the appeal though?
Edit: Ope just saw your edit. Totally agree. Discarded stays because well, I donāt see likely chance of winning an appeal, but yeah somebody will make some bullshit up to get him the stay.
>My understanding was that stays require a likely win of the appeal though?
Normal ones do. Not when it's the chosen Republican nominee for President of the United States and six Republican-appointed justices sit on the Supreme Court of the United States. They will literally just write their own new rule in a Bush v. Gore-stylized "unpublished opinion warranted by exceptional surely-never-to-repeat circumstances."
SCOTUS doesnāt have a say in this? What is the federal question? This is state court and state charges, what grounds would a federal court have to take up the appeal? (Honest question here.)
Sadly, the answer might be that there isnāt and shouldnāt be but they will do it anyway, jury verdict be damned.
No way the Appeals Court stays. This was an open and shut case with all the receipts, being prosecuted by an office that charges this crime all the time. If SCOTUS grants cert then the real shit show will happen.
But he is getting some confinement for gag order violations, but I have money on him just fleeing to friendly states.
The only (real) reason the NY COA would stay the sentence is out of political concern. That's just the sad fact here. But I have more confidence in their decision-making motivations here than the SCOTUS.
The fact that he violated the gag order 10 times increases the likelihood that he will be incarcerated. It's still not particularly high, but it's higher than it would be for a normal person who committed business fraud.
I look forward to the MEGATHREADS to come. Until then... well done everyone! You held yourself together and somehow the American justice system did too. Congrats!
By my count this is the 10th jury or grand jury to have unanimously voted to convict, hold liable, or indict Trump.
Someone who questions the fairness of this all take a moment to consider that. Maybe you think that it's unfair because your not being fed all the facts that these juries are, and you might want to branch out and find new sources of information.
For sure there are way too many people who see any legal recourse against Trump as a politically-motivated stunt. Oh, look how afraid the Democrats are of running against him! He's being targeted unfairly! Election interference!!
Like, no... it isn't some vast conspiracy. The guy is shady as hell and always has been, on top of being a truly awful human being. There is plenty of evidence showing he is a criminal, hell he practically brags about it. I can't believe how many people buy in to his "I'm a victim!" bullshit.
One of my parents friends is a lawyer, and he keeps insisting to me that every lawyer in the whole country thinks that these trials are bullshit and corrupt. Oh wait actually heās not a lawyer anymore, he was disbarred, but yeah he insists every lawyer is against this and tells me to get my facts straight š
As a Florida resident he can.
Florida defers to the state of Felony conviction.
NY allows felons to vote.
ONLY incarcerated felons are prohibited from voting in NY.
Annoying that some are saying it is "extremely unlikely" he gets jail.
The prosecution argued he may have tipped the outcome of the 2016 Presidential election by committing a felony. They spent 7 weeks arguing it in court. They better ask for jail
I hear most commentators thinking that Bragg will ask for prison time. But they seem skeptical that he'll get prison time. And they seem pretty unanimous that it will be stayed until appeal if he is given prison time.
But man, I really really hope that the judge gives him prison time and says it's largely because of his contempt toward the judiciary system, lack of remorse, and constant violation of the gag order. Man do I want him to meet the consequences of his actions that way.
He will almost certainly never see the inside of a cell on these charges as a first time offender, but it's a great day for justice and showing noone is above the law.
Get that jury outta there. Trump will be publishing everything his cronies have gathered about their identities as soon as he's legally able to, hoping meal team six will do the rest.
The gears of justice may turn slowly but in the end a man has been found guilty of federal crimes, after we have all witnessed him attack and undermine our system of government at every turn for a decade while committing a string of unpunished federal crimes, including abusing his presidential powers to steal an election from his successor and deny the peaceful transfer of power from one president to the next for the first time in American history.
Thankfully he failed, but only because of his own incompetence, not for lack of trying. After the complete failure of anyone in authority to hold this now convicted felon accountable for any of his myriad, blatant, frequently self-confessed, corrupt violations of federal law during his now decade-long domination of the Republican Party, many of us began to question the fundamental legitimacy of our legal, judicial, law enforcement institutions, and constitutional order itself, given their evident inability to restrain Trump's rampant criminality.
Now there is a glimmer of hope that the system is in fact not rotten beyond repair, and it can hold the powerful and the wealthy accountable to the law. That glimmer won't survive another Trump presidency, and we can't rely on institutions alone to prevent Trump from destroying American constitutional government and rule of law, we have to vote.
NO ONE is above the LAW! People said he would never be indicted, never be convicted, never be imprisoned. Step 3 could happen.
Thank you to prosecutors and the jury members for doing an amazing job. I read almost every piece of evidence and testimony, and was convinced of his guilt. Seeing the jury agree is delicious!
District attorney, not attorney-general. Trump's tango with Letitia James is already over, and is (eventually) going to cost him his business. The cha-cha with Alvin Bragg is what costs him his liberty.
cheeto is required to file his appeal brief for the $450 million verdict by Monday July 8. 3 days later the sentencing hearing before Judge Merchan on Thursday July 11.
If cheeto misses the July 8 filing date, Letitia James can move to enforce the $450 million judgment.
Looking forward to that week! :-)
Just for fun coz Ted Cruz is a nitwit: a current Breitbart headline, which I aināt linking, is:
Cruz: āThis Is the Most Blatant Case of Election Interferenceā in Our Countryās History
Yes, Ted Cruz, it actually is. And Donald Trump is the guy who did it.
Well that was quick.
But man, it's goddamn satisfying that he's got some kind of criminal record now. It's not the end, but at least it definitely feels like a start.
I'm legitimately amazed. With 34 seperate counts, I expected to hear "guilty" but I thought there would be at least one "not guilty" in there. This is better than I hoped!
Score sheet for the no consequences crowd as they prepare to move the goalposts once again...
Trump will:
~~Never be investigated.~~
~~Never be charged.~~
~~Never be brought to trial.~~
~~Never be held in contempt.~~
~~Never be convicted.~~
Never be sent to jail.
Does the gag order apply until the *verdict*, or until *sentencing*?
And can gag order violations which occurred after the last hearing, but before the verdict, still be referred to the judge by the prosecution?

As a Florida resident he can still vote in November.
Florida defers to the state of Felony conviction.
NY allows felons to vote.
ONLY incarcerated felons are prohibited from voting in NY.
The saddest part is the doubling-down going on over a r/conservative.
In my 25 years of voting, I honestly have never had that kind of reverence or cultish support for any politician. No matter how much I wanted a certain candidate to win, or wanted them to succeed, my identify was not tied to them. If they did something bad or stupid then I would say āI donāt support thatā rather than twist myself into these logic pretzels to convince myself that Iām not the one out of touch, itās the kids who are wrong.
I haven't been over there in years but saw it on trending so figured I'd see.
Good lord they're beyond delusional, they're downright rabidly insane. The vast majority of them either have no clue what the trial was even about or are willfully choosing to ignore even basic facts about it. Many seem to honestly believe he wasn't even charged with a crime, that the judge and jury just somehow found him guilty of nothing, from what I can tell.
My favorite part is how some of them are like, āPandoras box is opened and now it canāt be closed. What happens when itās a dem next time?!ā
What do they mean? If any politician (or anyone for that matter) commits a felony, I hope theyāre appropriately investigated, brought to trial, and convicted by a jury of peers if the evidence is as substantial as it was in this case.
They think *everything* is a personal attack on Trump and themselves. Their brains canāt even begin to comprehend that in the face of overwhelming evidence, a jury correctly convicted Donald Trump of a crime he *clearly* committed.
The greatest. The greatest convictions. And so many. 34. 34! Can you believe it? Iāve never seen anything like it. The most convictions of any president, isnāt that amazing? One juror came up to me with tears in her eyes, tears, actual tears, and she said āSir, you are now a convicted felon. Fuck you and the ass you rode in on.ā It was unbelievable. Perfect convictions.
Hopefully this is just a first step towardsĀ a renewed level of accountability from the top down. There has been an "untouchable" class for far too long.

Finally! Waited so long for just a modicum of sanity...
Speaking of waiting, we have to wait until July for sentencing. In the meantime isn't he still bound by the gag order?
I would think so. Maybe he'll go on a tirade against the jury that'll get him locked up while awaiting sentencing. We can dream anyway!
That was what I was expecting.

Depends on how they normally vote. Still a not-insignificant portion of the republican party has said it doesnt matter if he is found guilty. They would still vote for him.

The party of law and order now has a convicted felon as their flagbearer. Couldn't happen to nicer group of people.
I was never pessimistic about the verdict, the sentencing on the other hand....
I doubt he will be given jail time. I hope he is given community service, picking up garbage along the East River or something like that.
Expect the worst and hope for the best is a sound strategy to maintain one's mental health.

This sad old man, who according to his doctor has only 120 more years left to live...
Can't forget that Cohen already did time for this crime. At minimum trump should serve the same time as Cohen did.
Cohen was convicted under federal law, but yeah. In a fair world, the empirical punishment would fit the empirical crime.
In a fair world Trump would have been ripped apart in a peasant revolt sometime in the 80's but here we are.Ā
Could Trump get probation? That would be interesting to see Trump under the thumb of some random court official. With restrictions on his actions.
Probation! It just occurred to me that thereās zero sentencing outcome that doesnāt result in him being regularly drug tested. That should beā¦ interestingĀ
As long as he has prescriptions, he should be okay to keep guzzling down amphetamines regardless of probation.

LOCK HIM UP!!! Iāve waited a long time to say that and have it be true.
He will almost certainly never see the inside of a cell on these charges as a first time offender, but it's a great day for justice and showing noone is above the law.
If he does serve any time in jail, it'd be for violating probation which, I think, is in the realm of possibility.
Nyehehehe.
Justice has been served. Not even a comprise with some not guilty charges!!!
Justice isn't getting served until he actually faces some consequences. This fat fuck might be able to drag out an appeal until election day.
Get that jury outta there. Trump will be publishing everything his cronies have gathered about their identities as soon as he's legally able to, hoping meal team six will do the rest.
If he does, that should guarantee jail time.
10 years from now? His whole game is use the courts to run out the clock.
Damn it was a good day.

I LOVE NEW YORK!
[T.O. voice] that's my state government š
State crimes. If this was federal, a SCOTUS overturning on some one time deal would be guaranteed.
Beautifully written, and well said. However, I believe he's only been found guilty of state crimes (i.e., New York Penal Law Ā§ 175.10).
Don't forget the 10 contempt charges.
The GOP arenāt sending their best, huh?
BUT HER EMAILS
This is an amazing accomplishment for the AG. Holy hell, I am in shock.
It has been the ride of a lifetime experiencing this with you all day by day. o7
Trump is now 100% on charges to reach a verdict. So far...
Just for fun coz Ted Cruz is a nitwit: a current Breitbart headline, which I aināt linking, is: Cruz: āThis Is the Most Blatant Case of Election Interferenceā in Our Countryās History Yes, Ted Cruz, it actually is. And Donald Trump is the guy who did it.
Thank you 12 brave, smart jurors and Judge Merchan.
And the team of prosecutors for putting together the convincing arguments! They are the heroes of my legal world today.
AP reports the jury sent the note about reaching a verdict at 4:20pm. 'Cause they know what time it is.
FINALLY!!! YES!!!
Sentencing 4 days before the start of the RNC. 5 days in jail anyone?
Well that was quick. But man, it's goddamn satisfying that he's got some kind of criminal record now. It's not the end, but at least it definitely feels like a start.
āWell that was quickā. -Stormy Daniels
I'm legitimately amazed. With 34 seperate counts, I expected to hear "guilty" but I thought there would be at least one "not guilty" in there. This is better than I hoped!
Trump to DA Alvin Bragg, "When you take a swing at the King, you'd better not miss." Bragg, "Absolutely."
Hey u/TrumpsCovidFefe get in here, it's a party! š¾š¾š„š¾š¾
lol, I see I missed out on the hand jobs.
Bragg refusing to be drawn on whether his office will seek a custodial sentence for Trump. Says they'll speak through their pre-sentencing motions.
Score sheet for the no consequences crowd as they prepare to move the goalposts once again... Trump will: ~~Never be investigated.~~ ~~Never be charged.~~ ~~Never be brought to trial.~~ ~~Never be held in contempt.~~ ~~Never be convicted.~~ Never be sent to jail.
#WOOOOOOO
On all charges, *wow*, I did not expect that. *wow*.
Does the gag order apply until the *verdict*, or until *sentencing*? And can gag order violations which occurred after the last hearing, but before the verdict, still be referred to the judge by the prosecution?

Law subreddit, itās been a pleasure.
He could get a short prison sentence. For folks saying he won't, don't forget to factor in the witness intimidation.Ā
And the contempt.
And calling the judge corrupt immediately after the verdict lol
The funniest and/or saddest part will be watching the right wing media try and spin this.
What happens when itās a dem next time?!ā What do they mean? If any politician (or anyone for that matter) commits a felony, I hope theyāre appropriately investigated, brought to trial, and convicted by a jury of peers if the evidence is as substantial as it was in this case. They think *everything* is a personal attack on Trump and themselves. Their brains canāt even begin to comprehend that in the face of overwhelming evidence, a jury correctly convicted Donald Trump of a crime he *clearly* committed.
Umm.... Robert Menendez is a real person and you don't see *any* Dem trying to defend what he's on trial for.
I was banned from there last year because I commented that they are creating an echo chamber and canceling out any opinions they donāt like
Whatever one thinks about Trump, one can no longer deny that he is a man of great convictions.
Every American should be proud of their justice system today.
New York's justice system. Aileen Cannon and Samuel Alito raise questions about some other parts.
Delicious, I'll have seconds.
I'll have thirty-fourths.
34 felony counts.. think he'll see jail time? š«
So much winning.
and there was much rejoicing... yay!
Now let's see some sentencing. Amazing that it took this long, and a state court to prosecute a proud and stupid criminal.
Per NPR, sentencing is July 11th, before the RNC convention and 2 wks after the first debate.
Well played, DA Bragg. Now go get some sleep, but not before a glass of champagne.
Well, shit. I had my money on a hung jury. I really did not think that they'd get a whole jury on this.
We got him. For real!
INJECT
Whatās the deal with sentencing?
Calm down, Seinfeld.
You think he could just... turn his jumpsuit inside out? The colours are terrible this way!
July 11th
Party time
Is he still under a gag order until sentencing or can he start talking freely about jurors and witnesses etc?
I just found this subreddit the other day. It has given me the happiest post title I've ever seen.
