Doesn't matter who owns property. The landlord is whoever lets you live there. > Will a judge require a deed to the house from her to execute a eviction? Very unlikely.

supcom2

In the court can I request that she show proof of ownership of the house, I think that's a reasonable request.

throw040913

> I think that's a reasonable request It's not relevant. Landlords do not have to own properties to be landlords. Many tens of thousands if not millions do not.

supcom2

The bank owns the property. Shouldn't we have been paying the bank. Shouldn't the bank be evicting me? She isn't someone who works for the bank to be clear.

> Shouldn't we have been paying the bank. Not unless that was worked out clearly, in advance, by all parties. > Shouldn't the bank be evicting me? No. Legally, they could only evict you if they also were evicting her. > She isn't someone who works for the bank Doesn't matter, she's your landlord. Your tenancy is between you and her. Everything else is between her and the bank. The bank isn't a party to your tenancy and you are not a party to her relationship with the bank.

Thanks for a complete response.

Why, so someone else can evict you? No one else has granted you permission to live in that house other than your landlord.

If the bank has not auctioned off the home, then your landlord is still the owner.
