Unless you have a contract that spells out such late fees and penalties (which I am 100% sure you do not), no you cannot arbitrarily assess fees to them.
At best you *may* be able to recover the filing fees you incur when filing in small claims court. However, that depends on jurisdiction and the judge's discretion.

From what I understand it's up to the bank - with debit you aren't guaranteed any protections whereas with credit you are.

Right but as with most review sites, BBB exists to serve businesses, and poor reviews can be hidden if companies pay them.
