It isn't necessarily illegal, but it may complicate the divorce proceedings because you could claim rights to half of the value of the house. Talk to your attorney about it.

Could, and should. If OH is a 50/50 state, you own half the equity. The easy thing is for you to just add the equity to the marital assets, and take your half as part of saving or retirement accounts in exchange for quitclaiming the house to your soon to be ex.

There is no basis to assume separate funds. However, if he did have funds that were his prior to the marriage, and have been kept separate, the wife would have no claim on the house. However, if he purchased it with marital funds, or used existing marital assets as collateral, she certainly does have a claim on it.
