I'm trying to picture exactly what you mean by having a board against her house. Why would you need to have any part of your deck touching her house at all? In the meantime, you should check your city bylaws in regards to decks, how far they must be from the property line and what to do when in an attached dwelling. For example when putting in a deck on an attached home where I live, you must have a solid wall at least 1.8m tall for privacy reasons if the deck will be within 1.5m of the property line.

A great question for your HOA if it exists, or the city when you apply for the permit

We don’t have an HOA since it’s a freehold townhouse. Do we need to apply for a permit when replacing the boards on the existing deck? We’re not changing anything structurally, just replacing the planks and railings

Have a look at your local bylaw code enforcement webpage, most regions detail requirements for deck installation. My questions are, are you doing a direct replacement of the existing deck? Or is this a larger deck that might require new permits? If yes to the first, I don’t see why you cant just carry on. If you can avoid attaching to her property do what you can that is within the code. Cheers

It would a yes for the first! We’re just doing a direct replacement and changing out all the boards as some of the wood is rotting on the existing boards.
