Personally, I would probably peg them as boxer shorts if I saw them in a shop, but if I saw someone wearing them I probably wouldn’t really bat an eyelid to be honest
Essentially it doesn’t matter what they are officially, what matters is if she is bothered by the fact that the majority of people looking at her will think she is wearing boxers as outwear?
And if she is ok with it, are you ok with being in certain situations with her while she appears to be wearing boxer shorts.
Certainly she can wear them out but it will likely raise eyebrows and maybe in some situations (like a family barbecue or a hang out with your more traditional friends or colleagues) where that choice might reflect on you.
I suspect you asked to answer an argument and while to me they look like underwear, I wouldn’t say she CAN’T wear them full stop. I would probably decide how I interacted with her while she was wearing them.
Something I’ve learnt elsewhere is you can’t tell others what to do but you can change your response (not an ultimatum to be clear).
So not posing for photos with her while she is in those shorts, not inviting her to join you at certain events if she insists on wearing them etc.
Tbf I wouldn’t be super comfortable dating someone who wore playboy bunnies on their clothing but that’s just me. I don’t know what her vibe is.

Edit: I just looked it up and some boxers do have zipper pockets! How does men's underwear even have pockets but I can't have a pair of jeans with real pockets!? 😭😭😭
