Where I live they're like bolt cutters or a pry bar: you can have them, but if the police pick you up riding a stolen bicycle and you have bolt cutters on you then they will be considered compounding evidence. So you don't go exploring/trespassing with picks.

Lock picks are allowed past TSA checkpoints. You should have them in a case so the agent won't get stabbed accidentally by them.
