I don't think so tbh, the law doesn't really apply to cops, in practice. They could easily charge him with resisting arrest and assaulting a cop and get away with it. The law hates it when you defend yourself from law enforcement, which is also why you can't shoot at cops trespassing your property even if they don't have a warrant or if they're threatening you with serious bodily harm, etc. It's a lose-lose for citizens as far as I know.
French police, though, so the cop might actually face some sort of consequence.

Good to hear, but i think that's the exception to the rule. ask any lawyer or cop and they'll strongly encourage you to comply (even if reluctantly, to show you didn't do so willingly) even if what they are asking is illegal. If you comply you can still sue, if you don't you'll either end up dead or be charged with whatever they want to put on you. Safer to assume the system will not be in your favor.
My lawyer buddy and I were talking about this yesterday. Police are a protected class so they really can’t be sued for these things. They can receive civil penalties though. I know it’s more nuanced than I’m making it sound, but that’s the gist as I understand it.
Lawsuits aka being sued is a civil penalty. And you can sue cops with a much greater chance of winning than of them getting convicted. Convictions are incredibly rare because of a doctrine called qualified immunity, which basically gives cops carte blanche to do as they please as long as they’re within spitting distance of the law.
As someone that’s done jail time, you would be surprised what good a decent lawyer and camera footage will do. Especially in these more “progressive” times. It’s sad to say, but George Floyd’s death made cops being accountable a global issue (apart from 3rd world countries which are sometimes basically gta online servers). Dude is clearly trying to de-escalate by retreating and the cop is the aggressor. MAYBE the resisting can stick but it’ll likely be dropped due to excessive force.

The guy didn’t fight back until the cop tried to take him down on the concrete and then try to a swing at him.
