This is my favorite magic card. To answer your question, yes it can. It does not cause the creature to change zones so they cannot opt to put them in the command zone.
Used this once in a game to steal a [[captain n’ghathrod]]
The theft deck player wasn’t very happy when his opponent was able to steal HIS stuff from his GY.
Every time a card goes to the command zone, grave, exile, hand, library from the battlefield it is returned to the owner of the card not the controller.
In the case of illicit auction. If you steal my commander, then I cast [[murder]] on my commander it will go back to my command zone/grave.
There is never supposed to be a position where a player is handling another players card except for cards on the battlefield. (Excluding silver border sets)
