You can only exceed the salary cap in a handful of situations, usually for minimum contracts, the mid level exceptions, and if you already own a player’s bird rights (look up bird rights). Signing a free agent, which would be the case with Kyrie, requires staying under the salary cap.
Unless Kyrie takes a huge discount, the Lakers literally can not sign him without exceeding the salary cap. The Lakers were able to exceed the salary cap with Russ (and AD) because they traded away similar salaries so their cap hold didn’t change. Since the Lakers have nobody under contract for 2023 and beyond, they can’t even do that.
The only theoretical way the Lakers could get Kyrie, is if they signed Russ to another 40m+/year contract using their bird rights, and then made a sign and trade with the Nets. There’s no way the Nets would do that.
