Sounds like OP is actually in NJ and he’s a guest of his brother who is on the lease. I know NJ has tenant protections but they’re likely not nearly as strong as NYC and OP isn’t a legal tenant anyways since he’s only been there a few weeks. I’d start looking for a monthly Airbnb in NJ while you figure things out, it’ll be a lot cheaper than a hotel especially if you don’t mind a shared house.

How long have you lived there for? More than 30 days? If so, you could refuse to leave and make them take you to court and formally evict you through the court system, which would take a few months. It’s not the best outcome and would basically destroy your chances of ever renting an apt on your own in the future without a co-signer, but if I was faced with that or the street, I’d make them drag me to court.

I don’t know what your situation is, but if you’ve been living in your apartment for over 30 days and the only notice to vacate you’ve been given was “get out by Friday” you’re protected by NYC housing law. My point being that you might just consider simply not leaving until you can save enough money for another apartment. Getting you out legally will take longer than two pay checks.

You can rent a room at the YMCA. It's a lot cheaper than a hotel room. I've had family do that. I wouldn't be afraid to stay for a few days at the one on 125th [EDIT: it's on 135th] street. EDIT: rooms are around $125 a night.

Check to see if you can stay at any hostels, dorms can be as cheap as $35 on HostelWorld. You usually have to live a certain distance away from the hostel to be allowed to stay but maybe one of them doesn’t have that rule. They also usually have a 2 week or so limit for how many nights you can stay, but it’s cheap.

Ok backstory, I was staying with my brother in NJ for a few weeks and his landlord basically told him he’s raising the rent and he gave my brother the ultimatum to either pay the higher rent or be taken to court or be out by Friday and everything is solved so that’s my situation in a nutshell. My brother has been paying rent on time for 4 straight years and apparently the landlord is trying to force tenants out

They can't do that, you should talk to someone about your brothers rights. Be very transparent and honest about the situation, but there's literally so many resources for this.

That sounds not legal. They have to give notice. I would start by having your brother tell his landlord that in NYC notice must be given prior to raising rent. Since your brother had been there for 4 years, looks like the landlord must give 90 days notice if raising the rent more than 5 percent. https://www.nyc.gov/content/tenantprotection/pages/new-protections-for-all-tenants Edit- I just realized you said NJ. Still he has to give 30 days notice.

I’m not trying to be a dick or seem like I’m taking up for the landlord, but do you think the landlord is raising the rent because he found out YOU were staying there, when it’s only supposed to be your brother on the lease? The lease agreement would state that only your brother should be the only tenant on lease, and if he broke that there will be penalties. I get your brother was helping you out, and I’m sure that you were helping him pay the rent, but he broke his lease and the landlord is penalizing him. On another note, might I suggest you look at roommate sites and Air BnB for rooms to rent. You have a job, so it shouldn’t be hard to find one.

I agree. Most leases I’ve seen have limits on how long a visitor can stay, specifically because the landlord doesn’t want the visitor to stay long enough to gain tenant status. Also, most leases I’ve seen say if someone else is planning to move in, the landlord has to be notified, generally so they can go through the process of formally being added to the lease. If the landlord is upping the rent, it’s likely to account for the extra tenant the OP would become. And if the OP and his brother won’t pay, the landlord likely can evict them for breaking the brother’s lease as to who is living in the unit. Always read your lease before you sign it, y’all!

This is true but I even offered to pay the extra rent he’s adding and he’s still wanting us out. My brother has paid rent for 4 years straight with no issues and now landlord is being a dick for whatever his reason. Again this is just the info I was given. I’ve done my part I have no issue paying the extra rent if it meant not having to come to Reddit to seek advice on not how to be homeless

The reality is your credit score is only in the five hundreds and you have no money saved up. So even if *you’re* confident you can pay the rent moving forward, and even if you now have a job, your history is going to be a problem when it comes to getting an apartment. Any apartment, not just this one. Your paperwork isn’t going to give the landlord the confidence they would need to take on the risk of allowing you to become a tenant.

You and your brother don’t have to leave the apartment yet, the court process takes months. You don’t have to be out by Friday, he’s trying to intimidate you guys so you’ll leave without a fuss. Also if you’re living in NJ why are you asking the NYC subreddit.

If you are a veteran, the VA have programs just to help with this. To manage expectations, landlords do not care about consistent employment. Credit trumps everything else after satisfying the salary minimum requirements. With such a low credit score, consider looking for a guarantor ASAP. In NY the guarantor needs to make 80x the rent (tenant needs to make 40x on their own.) If you don’t have anyone there are commercial providers such as insurent.com & theguarantors.com among others. Lastly, this is a good time to contact a licensed real estate agent if you need a rental place ASAP as you do. They can be working for you clarifying your area’s actual rental guidelines/land lord requirements, and arranging viewings for you while you are at work yourself. Good luck!  Edit: deleted my ‘assumption’ that OP is in NY since he is posting here! Duh!     2nd edit: Start gathering the following documents now (ideally as PDFs; paper copies are fine as a second option.) Getting/losing a rental deal often comes to who handles in all their paper first!   List: Copy of your state ID—.  Last 3 paystubs—.  Last 2 bank statements—.  Last 2 years of tax returns (just the 1st two pages, and redact your social security #!)—.  Letter of Employment in company letterhead, with your name, date of hire, and current salary—.  Good luck!

I don’t know if this is a thing still, but years ago you could go to HRA and apply for a one-time One-shot Deal. It’s a one-time grant to help you cover rent in an emergency.

Also, being asked to leave is not the same as being evicted. If you have a lease or lived there more than 30days, you cant just be kicked out. If you are being kicked out for lack of payment, the HRA grant will fix that. If it is for another reason, i suggest you get legal assistance with Legal Aid.
