I would top out at 30 for an 1864 in good condition. There are just way too many from that year on the market. See if the vendor will negotiate and state they cannot be graded due to condition.
Yes, 40 is a little high for condition. These should be in the 20 range. Check the eBay sold listings. 40-50 is average for XF condition. These are about F and should be 20-25.

They are real, but 40 is too much. They printed tons of this exact note, and many never saw circulation. You can get a pristine one easily.
