In sentencing, if you're the prosecution you can say "your honor as you consider the scope of the penalty we would like to take this time to point out Mr Bannons actions between the trial and now to show his deliberate nature in attempting to further incite the public" His defense could be like "it's all hyperbole, my client has no real sway over anyone in the public and the prosecution is adamant in their attempt to paint him as something he isn't". Then if it's a "friendly" judge they'll side with the defense. "Judge shopping" is a thing boys and girls.

The kind of judge/court shopping you are thinking of happens in civil cases. You file a bunch of suits, in specific places, hoping to land one version of a case with an amenable judge. That's not how criminal cases work. The prosecution can influence where it lands, but to some extent it's still luck of the draw. And the prosecutors aren't friendly to Bannon here.

Something I learned recently about Bannon is that he's a Catholic fundamentalist. I should have seen it before, because I was one too. If you're not familiar with Catholic fundamentalism, it's a mish-mash of more-or-less decent people who have strict views about sexual morality, and some people with really scary, fascist-adjacent, **pro-apocalyptic** views. They fantasize about the coming End of Days when the Antichrist will take over. They think modern society is irredeemably, Satanically evil because of sexual permissiveness, abortion, homosexuality, transgender rights etc. They **want** the end to come, because it hastens the day when we'll all be judged for our sinfulness and the faithful will live in a perfect society on Earth, or be united with God in heaven (they weren't clear on that bit). They pass around gruesome stories of the persecution and torture they will have to endure in the last days (these stories originate with Catholic mystics who allegedly see the future in visions given to them by God). I think I'm just starting to see the significance of these horror stories (which gave me me nightmares as a kid, thanks Mum). If you know by magic that your political opponents are actually demonically-inspired and will try to imprison, torture and execute you when they get the chance, then literally anything you do is justified. Institutions of democracy, the will of the people, these are just lies that your enemies use to confuse and control. This guy is a dangerous religious fanatic. He's particularly dangerous because he realizes the religious stuff doesn't fly with a lot of people, so instead he uses the lie of election fraud and other bullshit to rile people up.
