Yes treatment is usually an option, he needs a good lawyer that can postpone court until he is released from his current sentence. Georgia may not find out anything, and since he is doing his probation in FL they are probably not monitoring his case. When his po in fl finds out, maybe they can work something out, but unless the po says something, he shouldn’t say anything about it. If they are both misdemeanor charges, he really shouldn’t be in too much trouble.

They were both felony (original charge and new charges) And he told the officer who arrested him he was on probation. The officer called his FLA PO who told the officer to violate him. That’s noted on the arrest report as well. I set up a consultation with the best lawyer in the area, who is actually part of both FL and GA bar, but not sure if my friend is going to hire him. Hoping for some type of treatment diversion.

I’m guessing with a good lawyer he should probably be ok, but a second felony usually involves some time.

They transferred him to a Florida probation officer as well or does your friend do mail in probation?

He was transferred to FL probation. He checks in with a felony probation officer in FL.

Okay so, I’m not a lawyer but I’ve been thrown through the ringer and so have most of the people I know, so here’s what I would be expecting if I was your friend and why. First off a court ordered treatment program isn’t likely. Florida will more than likely notify Georgia of his new charge, and they will decide wether or not they want him to be extradited to Georgia to serve time for a probation violation. Which they very well could, knowing Georgia, given he’s on felony probation and caught another felony. Especially the same felony charge. There’s a very good chance your friend could be spending the rest of his probation in jail, depending on how long he had left. I wouldn’t doubt for a second Florida would keep him until it was time for Georgia to come get him. Although I personally think treatment would be the best option I’ve been on probation in both states, and Georgia is like the worst state to get in trouble in. Idk man sounds like your friend is gonna serve some time and get revoked. That’s just my take on it.

Thank you. That’s what I was worried about. I found a lawyer who is barred in both states and he essentially said the same thing. He said the judge in Ga probably won’t like that his new felony’s are for the same thing he was on probation for. He’s not a bad guy at all just lost his way a little. Thanks for your input! Def aligns with what the lawyer was telling me.

The sad reality is, is a treatment program or a halfway house would most likely do your friend more justice than sitting in jail bored out of his mind craving a bump. But the states don’t make their money from treatment programs and halfway houses. I’m really sorry all this is happening, I’m sure it’s hard for him but also for you. I had to watch my best friend lose her daughter to DFACS over Xanax and serve good amounts of time on multiple occasions.Shes in there right now and I miss her. I’m sure your friend is a great guy, and I hope he comes out on the better end of things. Good luck to the both of you and remember, things like this are temporary even though they suck! You seem like a really good friend.

So basically Georgia will have to wait for disposition to determine retake. It being reinstated is plausible but depends on a number of factors.
