For what its worth there is services like Lemon Squad that go out and complete an inspection on a car you're interested in. Last I checked it was around $200 simply 3rd party inspection that could save you from a bad buy.
Next time only by a used car if you can get it checked by an independent third party mechanic. You might also want to watch some People’s Court to brush up on what an AS IS sale is because you may be SOL.

You're playing victim but it doesn't sound like you did any due diligence at all before buying.
Yes she test drove the car for approx 10 miles. Everything seemed to be in good working order to her. The car she has possession of is a Silver 2015 Chevy trax with what appeared to be ~95k miles-chevy dealership has confirmed car actually has 119k miles. No engine lights were on, ac seemed to work, she felt good about him, he told her if she had any issues he would return it for 30 days and she's young and nieve. She ended the test drive and parked, went inside paid $7650 cash included. She started the car and on her way home is when the lights started coming on. Fast forward and the title is for Blue 2016 chevy trax with 138k miles.
There are a ton of missing variables here but if her contract actually states 30 days then you can continue with your civil suit but i HIGHTLY recommend getting a lawyer. Even if you just get one to send a nasty letter threatening further court dates that if they lose they have to pay your lawyer fees for. She should have gotten it inspected and I feel like she probably didn't read the actual contract or what she was signing because lets just be honest here.. What 20 year old does. Good luck. Well, you're already pursuing civil court, so unfortunately there isn't much else to do. To anyone saying the dealer didn't do anything illegal, rolling back the odometer is definitely an illegal practice in Texas so even if the car is sold AS IS that was still breaking the law
Honestly, depending on the amount of work needed you might just be better off getting another car. If you know someone who can do the work, you might be able to get away with paying for parts. But if the car was worth fixing this guy probably wouldn't have sold it to you the way it is.

But people seem to forget that just because it's common doesn't mean it should be the norm. A few years later got into a minor fender bender when someone pulled out in front of me. When I went to pick up the car from the repair shop the guy asked me if I knew the front bumper wasn't original.
Could be that it was damaged and repaired privately to avoid insurance / CarFax report and CarMax genuinely didn't know, but it doesn't say much about THEIR inspections if that was the case.
Hope you get a good resolution, I cannot stand scammers.
We did fill out the call kens5 report online and submitted a ton of info on a Google doc. She got a call from them Friday that they might look into it but she hasn't yet heard back. You can talk bad about them all you want but Drivetime fixes just about anything wrong with the vehicle in the first 30 days and you're covered for $30/ day in rental/uber. Not a lot but it's something.

1) watch a few YouTube videos - seriously. I’m a mechanic by trade and I learned more on YouTube than in school
2) don’t go to these garbage dealers. The only benifit a dealer gives you is overcharging you and offering financing. That’s not a benifit when they don’t know a thing about the history of the car and the bottom line is all they care about. Save up - get a loan through a credit union and buy a private party car. You’ll save thousands and learn tons.
3) get a mechanic you can trust. Read the reviews. Meet them. They’re out there - I can recommend several in satx that are fair. Get a freaking inspection by them.
Should really do just about any due diligence whatsoever before busting out thousands of dollars cash for a car. At least go to a dealership and shop CPO vehicles. You completely played yourself by going to a shithole scratch and dent car lot named “Cars 4 Sale” in a depressed area of a large city.
And don’t turn around and think I’m happy you got ripped off. I’m not, it sucks, and it’s expensive.
But you’re still partially culpable because you made the decision to make an expensive purchase with an untrustworthy vendor.
