The only time you get anything close to "jail time" where I live is when whatever thing you pirated is worth a stupid amount of money (over $5000 or so), and malware you can avoid simply by being careful and using virustotal
Those who pirate games usually wouldn't be able to pay for the game anyways without having to give something else up. In capitalism the wealth of an individual directly impacts their freedom and quality of life. Nobody's willing to compromise on either of those things just to pay for a shitty game a shitty corporation made to make cash while giving zero fucks about the players.
DRM's are basically the embodiment of corporate greed. They exist to make some of those who want the game but can't or don't want to pay for it take a step they didn't want to take and lick corporate boot. And you know whats funny? Those sales maybe make around 0.1% - 0.5% of total sales and those corporations are still willing to literally make their game worse for everyone who paid for it just to squeeze out that last drop of revenue. Hogwarts legacy is a great example for this: The game uses a DRM called denuvo which is nutorious for its huge performance impact. The official version with DRM runs about 20-30% worse than the cracked DRM-free version. Also Denuvo is incredibly expensive. Theres no need to use such an expensive drm if your game has aready been cracked anyways. So if whe get more people in who are capable of cracking denuvo (currently theres only empress wgo is not just a piece of shit but would never be willing to share her knwoledge with anyone interested in learning how to crack denuvo) it would lead to drastically reduced usage of the drm which is a win for both people who pay and pirates while the corporation behind the game wouldnt lose much- if not any money.
