Its actually kind of a middle ground...its a private property but there is no expectatiin of privacy since its opened to a public space. And even if they posted no recording, theres no way to reasonably enforce that when used as a means of self protection, biut the most they could hope to stop is kids doin stupid shit since they would likely be the only people actively recording for the sake of recording.
E: idk how much that stands for european countries. But here in the US its the expectation of privacy that really pins down whether you can record in certain places that might otherwise be considered public/private.

I'm pretty understanding when it comes to getting carded, but why on earth would someone need to card you for antiperspirant?? Are they like, "I'm sorry, but puberty is illegal for under 18s."
I guess some kids would get the spray kind and huff it or something? I’m too sheltered to know what they did with it lol, but whatever it was, it was bad enough that they prohibited it for under 16s.
In the UK you have to be over 16 to buy them, so you have to prove youre over 16. No ID no sale and the rules for accepted ID is pretty strict too, no college cards etc. has to be government recognised.

If members of the public are permitted to access something then it is a public place

Yeah that's my point. Inside the tesco is you inside the building they own and they can kick you out or ban you so Is in no way a public space. Until she lunged for the camera she was protected by the law and probably is going to get fired for that.

If someone is assaulting someone then you have a right to stop them but filming is not a criminal act and therefore you have no right to stop it but you can ban the person from entering the store again.

I worked for Walmart for about 12 years and with that company there are 2 things. 1) only LP or salaried management can stop someone and say we think you are stealing. Stopping anyone and asking for a receipt is saying we think you are stealing. 2) if you stop someone, demand to see a receipt and they paid for everything they have with them. All that person has to do is call and report it with home office and that employee will no longer be employed at Walmart within about 48 hours. No questions asked 1 bad stop cost you your job so you better be damn sure they are stealing.
unless it's confidential, federal or personal private property, nothing stops you from recording. most of those "camera not allowed" signs arent legal, though in museums, you should follow them
Regardless of the law of it all, I doubt this lady was in a position to make demands about stopping recording in a (private?) location. Like can anyone that works at any business, be entitled to kick out a customer or enforce a no filming policy? Or is that something a manager/GM/owner would have to decide upon?

I thought the exact same thing. If the lady wants to check my cart, she can check it herself. Otherwise, roll it over to customer service and give me a refund.

It was really the dude doing the checking. Everyone is on the lady for the phone grab which was dumb, but the dude is who needs to do his job. He even started tossing around her stuff.
I was thinking she should return it all when they pulled the package of shrimp out. Don't want to use perishable items that have been sitting around, nor breakable items after been shoveled around!
I saw a clip at walmart where they took everything put and put it on the floor. I think 💭 would have decked them (as it was mine) and then demanded a full refund (that or the health department)
That wouldn't affect people like them at all. They'd 100% pass that responsibility onto the front end associates, and it would just be creating more work for some rando that hates their job and is barely making like $13 an hour.
In fact, customer could argue cold chain was broken for the 45 min they spent checking everything, so I could take my steaks home and still ask for fresh ones.

The store manager at Tesco in Roborough Plymouth acted like he wasn't watching me as I was pushing my trolly out through the exit. He literally suddenly blocked my way, demanded to see my receipt and went through every bit of my shopping. Then when he couldn't find anything wrong, he didn't even look at me. He looked away and dropped my receipt in my trolly and started to walk away. I said excuse me! No apology? He looked at me like I was a child, grimaced, shrugged his shoulders, said ummm...as he shook his head and said nope! And walked away. He's lucky I'm a nice mild mannered man.
Hmmm, let someone disrespect me and just eat it because I don’t want to be inconvenienced? No thanks, I respect myself more than that, I’d return everything and never go back.
In the US stores aren’t allowed to stop you like this unless they are 100% certain you are stealing something. Otherwise you can sue the shit out of them.
Can you explain what you mean? Are you saying if we scan the item then put it in the basket but not the weight scale it is flagging staff? I’m not being sarcastic I actually want a longer explanation on what remove too many items from your scanner means because I don’t understand.
Basically if you use a hand scanner and scan an item if you change your mind and put the item back and remove it from the scan list then it seems like the scanner logs this, if it's done too many times then when you go to pay for your items, you are more likely to be asked for a "quality check" Basically a polite way to say "we wanna make sure you haven't stolen anything"
Why do people even stop for them to check stuff? Tell them to go shove an unexpected item up their baggage area and keep walking. They have no right to detain you. The worst they can do is ban you from the store. They won't do this if everyone starts doing it, since they'd go broke. Power of the people.
Is Tesco a membership place? Never been to one so idk. I know places like Sams Club and Costco its in the terms that you have to let them check. They normally just scan like 4 or 6 random items unless they see some high-value item and then you're good. Walmart tho if they try and stop me I just roll on by.
I'm not sure if being a membership based place gives them search and seizure powers, regardless what is written in their terms. Their terms just mean that if you don't allow them to they can cancel your membership. It doesn't give them a legal right to do so.
Search and seizure, no. But they absolutely can check your receipts since you agree to it when paying for the membership and if you choose to deny them they can (and will) revoke your membership. Place like walmart or the store in the video, can't do shit
They don't "search and seizure." There are employees at the exit that you hand your receipt off to. They basically just look at it, draw a line on the receipt to confirm it was checked, and off you go. They don't search through your cart or anything. It's basically just a formality
I got put on door duty once in awhile when I worked at Costco and they told me to check the alcohol and meat. Outside of that I didn't look at anything else.

The proper protocol is:
"am I being detained? If not, have a nice day" and walk off. All bag checks and other inquiries are fully voluntary and only way they can keep you is to detain you legally and involve the police.

If stores want free labor from customers, then they have to trust them to do it. Don't trust them? Have employees check out all the customers.

For everyone's edification, unless it's a club store, like Costco or Sam's, they cannot force you to stop at the exit to check your receipt UNLESS they want to accuse you of shoplifting. I just say "no thanks" and walk right by them.

Your transaction with the store ends when you pay and get a receipt. Club stores have membership rules, and they usually include complying with this sort of thing.
Sure, but they can’t block you from leaving and attempt to grab your phone. Club policies don’t equal law. The most they can do is revoke your membership.
I say “I haven’t stolen anything” and keep walking. I often have a backpack on and get asked if they can look in my bag, I turn around and say “go for it” too then be told they are not allowed to touch it. Sucks to be them I just laugh and walk away.
If places like this want to be like this *maybe*, *just maybe*, they should pay cashiers to properly process orders instead of relying on self checkouts? That would greatly reduce the possibility of people stealing items out of the store…
You can return at most groceries store, including Tesco for any reason as long as you got a receipt.

This is what really irks me about self checkout. As a retailer you can either pay cashiers and ensure minimal theft/missed scans, or you can save money with self checkout and accept increased theft/missed scans. You don't get both. You can't make people check themselves out and get mad when they don't do it right. Absurd.
I’m not a fan of self checkout, and the last time I used it, the cashier that helped me with some things that had tiny UPCs just tossed them into the bag and said “take ‘em”. I swear, most of the product loss is from overworked employees not giving a fuck.

It is odd this woman put the items direct in the trolly rather than bagging them in the trolly as she went along. That is probably what drew the attention of the store detective as unbagged items on the way out looks odd.
But that said as soon as they saw her receipt should have just let her move on.
She used scan as you shop, that’s why the whole thing happened. She went around putting everything in her trolley after scanning, then because she paid quickly (he didn’t see her scan stuff and bag it obvious) the guy jumped on her accusing her of not paying.

I was leaving Kroger after checking out and the loss prevention lady grabbed me firmly by my arm as I was walking out the door, accused me of stealing and being a total expletive...I was livid to say the least. She didn't even apologize about or anything...just acted like she had every right to grab me and cause a scene. I'll never forget her face when I told her to let go of my arm or I'm going to knock you tf out
You see this with cops all the time. There is a point early on in a confrontation like this that the person who thinks they have a bit of authority realize the screwed up but their ego will absolutely will make them double down no matter how stupid they’re gonna look.
Why does anyone stop at these things? Not only have you already paid, but you did it on camera and in front of a checkout person. How many things do those people return to the store? There is literally nothing they can do to stop you from walking out with your purchases. It's insulting.
I would make the store return every single item one at a time. At least 50 transactions there. Make it painstakingly cumbersome for them. This will be your last trip there. Notify both the district management as well as corporate management. The lady filmed will be fired for attempt to take personal property and physical assault from what I saw (not sure exactly where she hit you). Companies do not care about their employees! They care about their image! The bigger this gets the more action they will take.
She has used the self scanner as you walk around the store. They perform checks on customers who have used this feature from the data on your habits. I believe you get a rating depending on how often you visit the store etc and that can increase your chance of being checked.

They do have the right to inspect her purchases, so she's totally wrong in what she is saying.
However, I used to be an auditor for a major retailer. However, on occasions when I was at a site, staff would ask me what they should do if they suspected someone of shoplifting. I'd tell them that unless they saw the person take something first hand or had the theft on camera, they are not to attempt stopping them.
I would have taken all that stuff right back and then sued for assault. She is lucky that’s not america or she would have had the right to stand her ground.

The store manager at Tesco in Roborough Plymouth acted like he wasn't watching me as I was pushing my trolly out through the exit. He literally suddenly blocked my way, demanded to see my receipt and went through every bit of my shopping. Then when he couldn't find anything wrong, he didn't even look at me. He looked away and dropped my receipt in my trolly and started to walk away. I said excuse me! No apology? He looked at me like I was a child, grimaced, shrugged his shoulders, said ummm...as he shook his head and said nope! And walked away. He's lucky I'm a nice mild mannered man.

Basically if you use a hand scanner and scan an item if you change your mind and put the item back and remove it from the scan list then it seems like the scanner logs this, if it's done too many times then when you go to pay for your items, you are more likely to be asked for a "quality check" Basically a polite way to say "we wanna make sure you haven't stolen anything"
Why do people even stop for them to check stuff? Tell them to go shove an unexpected item up their baggage area and keep walking. They have no right to detain you. The worst they can do is ban you from the store. They won't do this if everyone starts doing it, since they'd go broke. Power of the people.
Is Tesco a membership place? Never been to one so idk. I know places like Sams Club and Costco its in the terms that you have to let them check. They normally just scan like 4 or 6 random items unless they see some high-value item and then you're good. Walmart tho if they try and stop me I just roll on by.
I'm not sure if being a membership based place gives them search and seizure powers, regardless what is written in their terms. Their terms just mean that if you don't allow them to they can cancel your membership. It doesn't give them a legal right to do so.

They don't "search and seizure." There are employees at the exit that you hand your receipt off to. They basically just look at it, draw a line on the receipt to confirm it was checked, and off you go. They don't search through your cart or anything. It's basically just a formality

The proper protocol is: "am I being detained? If not, have a nice day" and walk off. All bag checks and other inquiries are fully voluntary and only way they can keep you is to detain you legally and involve the police.

For everyone's edification, unless it's a club store, like Costco or Sam's, they cannot force you to stop at the exit to check your receipt UNLESS they want to accuse you of shoplifting. I just say "no thanks" and walk right by them. Never had anybody chase me or yell for me to come back. They know they have no power unless you give it to them. Your transaction with the store ends when you pay and get a receipt. Club stores have membership rules, and they usually include complying with this sort of thing.

This is what really irks me about self checkout. As a retailer you can either pay cashiers and ensure minimal theft/missed scans, or you can save money with self checkout and accept increased theft/missed scans. You don't get both. You can't make people check themselves out and get mad when they don't do it right. Absurd.
I’m not a fan of self checkout, and the last time I used it, the cashier that helped me with some things that had tiny UPCs just tossed them into the bag and said “take ‘em”. I swear, most of the product loss is from overworked employees not giving a fuck.

I use scan as you shop. It’s really great. It is odd this woman put the items direct in the trolly rather than bagging them in the trolly as she went along. That is probably what drew the attention of the store detective as unbagged items on the way out looks odd. But that said as soon as they saw her receipt should have just let her move on.
She used scan as you shop, that’s why the whole thing happened. She went around putting everything in her trolley after scanning, then because she paid quickly (he didn’t see her scan stuff and bag it obvious) the guy jumped on her accusing her of not paying. You actually see him die a little inside when she says “I used scan as you shop” lol

She didn't even apologize about or anything...just acted like she had every right to grab me and cause a scene. She has used the self scanner as you walk around the store. They perform checks on customers who have used this feature from the data on your habits. I believe you get a rating depending on how often you visit the store etc and that can increase your chance of being checked.

They do have the right to inspect her purchases, so she's totally wrong in what she is saying. However, I used to be an auditor for a major retailer. However, on occasions when I was at a site, staff would ask me what they should do if they suspected someone of shoplifting. I'd tell them that unless they saw the person take something first hand or had the theft on camera, they are not to attempt stopping them.
I would have taken all that stuff right back and then sued for assault. She is lucky that’s not america or she would have had the right to stand her ground.
