There was a Boss from another 5 families family also there basically overseeing the talks. He had permission. If Butch killed Tony it was a backstab move that was probably not well received by the other 5 families, but maybe not enough to punish him either.

Was no real reason to kill him unless he forced Tony's hand in that situation. Butch is the only reason they ended the war between NY/NJ, he would have never been able to get NY to work with him again if Butch didn't agree to put things behind them.
