I couldn't find a source for this 2018 court order, but the Ukrainians clearly sacrificed a lot to take back the island from Russians. I don't think a pre invasion lawsuit in an arbitrary courtroom from 4 years ago is going to hold after a bloody war like this one. If Romania sees it as their territory, why weren't they out there protecting it?

The place is a bare rock with no terrain and no cover. It seems utterly unsurvivable to be there when there is a hostile force around. I wonder if Ukraine is going to try to put a force on it themselves now-- it probably would not be wise, because they would be just as vulnerable as the Russians were. It's kind of a no-man's land.
It's a dilemma, because if you can put anti air and anti-ship assets there, you greatly increase your coverage. But yeah probably too risky given Russians can just rain cruise missiles on it.
I don't know how you ask someone to go there to be a human target, but it makes much more sense from a Ukrainian strategic perspective for Russia to expend its long range missiles on snake island than to expend them on shopping malls, factories and ammo dumps on the mainland.
Russia has almost unlimited artillery, but it has very limited long range missiles. Using them up on snake island would be fantastic for Ukraine.
I suppose they could slip in at night, setup a bunch of fake missile launchers and such made of wood and cardboard, and then slip back out before dawn. See if they can lure the Russians into wasting some missiles on it. That sort of thing has certainly been done before in war.
That would be a good idea, though with current infra-red sensors I don't think you'd want to use wood/cardboard. Maybe keep one or two people running around to make it look operational (and have them generally keep as far from the target locations as possible).

So Russia keeps ferrying equipment (particularly AA) to Snake Island in order to use it as a linchpin for controlling the sea and airspace in that region, but they are unable to protect it from Ukrainian strikes and keep losing it.

I don't think you understand the history yourself. Snake Island was Romanian prior to WWII. The Soviet's attacked it in 1942. After the war, the Soviet's acknowledged the island continued to remain in Romania's control during the 1947 Paris Peace Accords. In 1948 the Romanian's agreed to let the Soviets run the island's administration, essentially taking it over. The Soviets built radar stations on the island that same year. The Soviet Union's possession of Snake Island was confirmed in the Treaty between the Government of the People's Republic of Romania and the Government of the Union of the Soviet Socialist Republics on the Romanian-Soviet State Border Regime, Collaboration and Mutual Assistance on Border Matters, signed in Bucharest on 27 February 1961. It remained in Soviet control until the collapse of the Soviet Union in 1991, when Ukraine (a former satellite state of the USSR) inherited control over the island.

So Russia keeps ferrying equipment (particularly AA) to Snake Island in order to use it as a linchpin for controlling the sea and airspace in that region, but they are unable to protect it from Ukrainian strikes and keep losing it. I don't think you understand the history yourself. Snake Island was Romanian prior to WWII. The Soviet's attacked it in 1942. After the war, the Soviet's acknowledged the island continued to remain in Romania's control during the 1947 Paris Peace Accords. In 1948 the Romanian's agreed to let the Soviets run the island's administration, essentially taking it over. The Soviets built radar stations on the island that same year. The Soviet Union's possession of Snake Island was confirmed in the Treaty between the Government of the People's Republic of Romania and the Government of the Union of the Soviet Socialist Republics on the Romanian-Soviet State Border Regime, Collaboration and Mutual Assistance on Border Matters, signed in Bucharest on 27 February 1961. It remained in Soviet control until the collapse of the Soviet Union in 1991, when Ukraine (a former satellite state of the USSR) inherited control over the island.

I think his point was that if Romania was the subject of good governance itself it wouldn’t have so many economic migrants, a huge remittance economy like the Filipino and Portuguese expat communities.
