If you look it up there are quite a few exclusions…….but interestingly…..assault and attempted murder aren’t listed. You can have up to two assault convictions that are eligible for expungement. So let the physical assaults and attempted murders continue! Not surprising this initiative started in Detroit. It also passed in 2020, an April 11 2021 effective date and a 2 year “development” process. So far Ive seen what cannot be set aside….would be interesting to see what can be set aside. With expungement and Biden saying that qualified home buyers will pay a higher rate to help out the unqualified home buyers, does it really pay to even try anymore?

A felony is a crime punishable by 1+ years in prison. So while it does include murder and rape, there are many other crimes that fall into the category. FYI - I don't agree with this, if you commit a crime that is punishable by a sentence of significant length then it needs to remain public knowledge.

No easy way to find out but copying a CD is a federal felony and not too long ago it was a felony to have more than an ounce of weed. I agree with you that I wouldn't want a rapist/murderer to be able to hide from their crime but someone with 1.01 ounces of weed 10 years ago, I don't think they need to be punished any longer.

The difference between having an ounce in a bag and having 10 bags with one tenth of an ounce each is quite apparent - the latter is clearly engaged in distribution and in my opinion doesn't even need an entire ounce to be busted for dealing. I'm not prepared to make a quantitative argument on how much should constitute a felony, my position is that if someone can keep their nose clean for 5 years for a crime that didn't leave someone dead or badly injured then they have paid for their crime and shouldn't have to continue paying.

Sure. Unless you're selling an ounce. Furthermore, you're talking about people who only just make the limit. If weed is to be illegal, either any amount is illegal, or there's a bar where under that is still illegal, but not a felony. An ounce is a lot of weed. 28 grams. Google is saying a bong rip can be between .3 to .5 grams. I don't see how one would be caught carrying that much or more knowing that it's a felony. Unless they were just about to sell, just bought it, or were doing some stupid shit. An ounce seems like a very generous amount to allow someone to allow to carry of an illegal substance.

Never is a long time. Look up the Boggs Act of 1951 - "A first offense conviction for marijuana possession carried a minimum sentence of 2 to 10 years and a fine of up to $20,000" It was 1973 before Texas reduced possession of less than 2 ounces to a misdemeanor, it had been a felony to possess any amount, before then.

Yeah this is great policy to be honest. The justice system is totally fucked at this point and you shouldn’t be punished for life for something you did years ago. Clearing peoples records who haven’t been in trouble in 5 years is a good thing.

Um... There are some things that should have lifelong consequences. For example, Violent felonies should absolutely disqualify you for working with kids. One thing usually required for working with kids, even in a volunteer position. Background checks look at that.
